All rights reserved. http://www.usgwarchives.net/copyright.htm http://www.usgwarchives.net/ga/gafiles.htm ************************************************ File contributed for use in USGenWeb Archives by: Lynda Livingston Walden jdwal@gulftel.com July 15, 2004, 11:12 pm Source: Greene County Georgia Courthouse Will Records, Pages 44-47 Written: September 19 1791 Recorded: November 7 1795 WILL OF ROBERT LIVINGSTONE 1791 In the name of God Amen--I, ROBERT LIVINGSTONE of the county of Greene and State of Georgia being in a sick and low condition but sound in memory and clear in judgment thanks to Almity(sic)God & being sensible of the mortality of my body and the Resurrection of the same, think proper to Dispose of all my worldly goods in the following manner--Viz- first of all, I bequeth(sic) unto my welbeloved wife JEAN LIVINGSTONE a genteel living out of my Estate as long as she Remains unmarried and next I give and bequeth(sic) unto my three sons, ROBERT, WILLIAM, AND JOHN all my lands and tenements with Equal Dividend to each and in case anyone of them shall Die, the surviving to be sole heirs of the Deceased and in case that two of them shall Die the survivor shall be sole heir and in case all of them shall Die minors without leaving issue in that case my land and tenements shall pass in the following manner, i.e. my nephew ROBERT LIVINGSTONE to have that tract of land I now hold in the forks of Oconie and likewise NE of the county of Greene and State of Georgia being in a sick and low condition but sound in memory and God & being sensible of the mortality of my body and the Resurrection of the same, think proper to Dispose of all my worldly goods in the following manner--Viz- first of all, I bequeth(sic) unto my welbeloved wife JEAN LIVINGSTONE a genteel living out of my Estate as long as she Remains unmarried and next I give and bequeth unto my three sons, ROBERT, WILLIAM, AND JOHN all my lands and tenements with Equal Dividend to each and in case anyone of them shall Die, the surviving to be sole heirs of the Deceased and in case that two of them shall Die the survivor shall be sole heir and in case all of them shall Die minors without leaving issue in that case my land and tenements shall pass in the following manner, i.e. my nephew ROBERT LIVINGSTONE to have that tract of land I now hold in the forks of Oconie and likewise my nephew AARON GRIER to have that tract of land I now live on but if any of my sisters shall come from Ireland to this place of Georgia, then and that case my Nephews ROBERT LIVINGSTONE AND AARON GRIER coming at said tracts of land in the way and manner before mentioned shall jointly stand Indebted to each of them so coming as before mentioned the sum of fifteen pounds if they shall come within the terms of seven years from this Date but if not they shall be forever bared(sic) but ROBERT LIVINGSTONE my Nephew coming at said tract of land before mentioned and in the way and manner before Described whether my sisters shall come or not he shall be obliged to pay unto his Brothers, WILLIAM AND JOHN LIVINGSTONE, the sum of fifteen pounds each and likewise AARON GRIER in the same manner and way shall pay unto his Brothers ISAAC AND ROBERT GRIER the sum of fifteen pounds and likewise I Do allow my movable property to be sold such as horses, cattle, hoggs(sic) or so much of them as my Executor shall think proper Reserving such a share as they shall see meet for they accomodation of my wife and children and I Do likewise allow the Rents and profits of my lands to be applyed towards the Raising of my children but if my wife should marry she shall have the third part of the sum Raised out of my movable property and my children live also but if my children should all Die minors and she survive her share shall be at the Discretion of my Executors if she does marry- and I do by these presents Constitute ROBERT GRIER and WILLIAM GRIER,Esq. sole Executors of this my last will and testament with powers Discretional and unlimited that if any Difficulty shall arise in any Devise or bequest, that in that case their Determination shall be my will and taken as such to all intents and purposes and shall be valid in law and if any of the above mentioned Executors shall Die before the Execution of my will shall be compleated(sic) in that case ABRAHAM BARNETT if then living shall succeed in office--and as the Education of my Children is a great part of my trust I Do also appoint ROBERT GRIER before mentioned my sole guardian of their Education, their Education to be a Regular Classik(sic) Education if that their capacity will admit and I Do likewise Impower him to Draw for the necessay expenses upon any fund or species of property that I do poses(sic) here or elsewhere and if at any time it should be Incommodious for my wife and children to live on the place where they now Do it shall be Right for my Executors to accomodate them most proper-And I Do hereby Declare this to be my last will and testament. Revoking all other wills, codicils and schedules whatever. In token and witness here of I have here unto set my hand and affixed my seal this the Ninteeth Day of September in the year of our Lord one thousand seven hundred and Ninty one and of American Independence the fifteenth. ROBERT LIVINGSTONE(his mark) (seal) Signed and acknowledge in the presence of THOS JONHSON ROBT JOHNSON JOHN CURTIS Greene County, Appeared the witnesses subscribing the within will & being sworn on the holy evangelest(sic) of Almighty Godd, depose that they saw ROBERT LIVINGSTONE dec'd- Sign, seal, publish & declare the within testament; and that at the time of his doing the same he was of sound, perfect & disposing mind & memory to the best of their knowledge & belief. and that they in his presence & in the presence of each other signed the same as witnesses. Sworn to and acknowledged by the widow this 7th November for 1795 before Wm PHILLIPS R.P. Registered Sept. 1791. AN INVENTORY OF THE ESTATE OF ROBERT LIVINGSTON, dec'd. Some items on the inventory are: a harrow, beds and bed steads, tables, cloth, books, a cupboard, jugs, pewter, a churn,pails, an oven, skillet, pots, a flax wheel, chairs, one cradle, bells, a curry comb, halter, buckle, a flour cask, 2 black mares, a brown horse, five sheep, honey bees, 18 geese, an ax, hoes, 3 plows, a barrel, a knife, a looking glass, a six-gallon keg, forks & knives, a candlestick, scissors, bridles, doubletrees, pickling tub, reap hook, hand towels, 11 cows. Sworn appraisers: PETER CARTWRIGHT, THOS JOHNSON, GILBERT GREER, 6th Nov. 1795 Then on Nov. 26th, 1796 these names: JAMES TAYLOR, JOHN KERR, THO.
