All rights reserved. http://www.usgwarchives.net/copyright.htm http://www.usgwarchives.net/ga/gafiles.htm ************************************************ File contributed for use in USGenWeb Archives by: Broughton (Bo) Mullins bmullinsjr@aol.com August 9, 2006, 9:55 am Source: Greene County Court Of Ordinary Written: August 6, 1872 Recorded: August 8, 1877 (Page) 30 Last Will and Testament of Nancy Williams ------- Item First Georgia * In the name of God Amen Greene County * I Nancy Williams of said State & County being of sound & sufficiency mind & memory & conscious of the brevity of this life do make & establish this my last Will and Testament hereby revoking all others. 1st Item,, I desire and direct that my body be buried in a decent and christian like manor - My soul I commit to God who gave it - relying upon the atonement of his son 2nd Item,, I desire and direct that all my just debts be paid without delay by my executor herein after named,, 3rd Item,, I bequeath and devise unto my beloved son William L. Williams and his children-now in life or hereafter to be born all of my estate-real personal and misced-to be held in trust for their use, benefit, maintenance and support for and during the natural life of my said son. After his death and as each of said children shall arrive at maturity or marry it is my will and I hereby direct-that the Trustee herein after named or his successors-shall pay over to said child and to all that are of age or married at that time-his or her respective share or interest in said Trust estate. 4th Item,,I furthermore will and desire-that if any of said children shall depart this life-without living issue, his or her share or interest in said Trust estate shall remain & go to the survivors,, 5th Item,, I hereby appoint my trusty friend William K. Mullins trustee of all the property given, bequeathed and devised as aforesaid,, 6th Item,, I hereby constitute and appoint my worthy friend, William K. Mullins executor of my last will and Testament. This June 11th, 1872,, Nancy Williams {LY} Signed-sealed-declared and published by Nancy Williams as her last will and testamentin the presence of us the subscribers-who subscribed our names hereto- in the presence of the testatrix at her special instance & request and in the presence of each other,, This June 11th, 1872, Chas A. Davis Wm Morgan James L. Brown State of Georgia * Greene County * Codicil to this my last Will and Testament,, I Nancy Williams of said County and State being of sound mind and disposing memory-desire before departng this life-to alter my last will and testament by making of this Codicil hereto, Item First,, For the love and affection I leave to my friend, Mrs. Julia Mullins I will and bequeath to her six-hundred Dollars in cash from my undivided estate to be paid to her at my death by my Executor-and I hereby appoint William K. Mullins her trustee-and to be invested in such way as she may desire using only the income annually. Item Second,,For the love and affection I leave to friend, William K. Mullins, I will and bequeath to him four hundred Dollars in Cash to be paid to him by my Executor from my undivided estate at my death. This April 8th 1872 Robert L. McWorter Margaret L. Hails Thomas W. Landrum Georgia * Greene County * Court of Ordinary August Term 1877 Persnally came into open court Wm Morgan & Thos W. Landrum-one of the subscribing witnesses-each to the within and foregoing last Will and Testament of Nancy Williams-late of said County-deceased and Codicil thereto attachd-who being sworn-say on oath-that they saw Nancy Williams-the Testatrix- sign-seal and heard her declare the same as her last Will and Testament and Codicil-freely-voluntarily and without any confusion whatever-that at the time of the execution of said Will and also at the time of the execution of said Codicil-said Testatrix was of sound and disposing mind and memory-that they the deponents-together with Chas A. Davis, James L. Brown & Robert L. McWorter & Margaret L. Hailes-signed said Will and Codicil respectively as witnesses in the presence of each other-& in the presence of the Testatrix Sworn to & subscribed before me-August 6th 1877. Joel Thronton * W.
