Copelan's Will State of Georgia Greene County In the name of God Amen, I, Jasper N. Copelan of the County and State aforesaid, being of sound and disposing mind and memory do make and publish this my last Will and Testament. Item 1st. It is my will and desire that all my just debts be paid by my Executors hereinafter appointed just as soon after my death as possible, and for the purpose of enabling my Executor to raise money to pay my debts I will and direct that my negro slaves Amos and Anthony to be sold, and if the money arising from the sale of said slaves should not be sufficient to pay my debts it is my will and desire that my Executor should sell such of my horses, hogs, and cows, such portion of my stock and perishable property as they think can be best spared from my estate; and my interest in the Livery Stable in Greenesboro (sic), with this exception in reference to my stock of horses. viz - I do not wish my three young mares to be sold, but I wish them to be retained by my estate as brood mares for the purpose of raising from them. Item 2nd, After the payment of my debts it is my will and desire that all the rest and remainder of my property, both real and personal, consisting of my plantation adjoining lands of Mrs. Billingslea, Mrs. McHenry, John E. Jackson and others etc. and my negro slaves, farming utensils, horses, hogs, cattle etc) be kept together until my youngest child Cornelius E Copelan arrives at the age of twenty one years, for the purpose of supporting and affording a home to my wife and for the purpose of affording a home to and supporting and educating my children until they respectively marry or arrive at the age of twenty one years. Item 3rd. When my youngest child Cornelius E. Copelan arrives at the age of twenty one years, after setting apart a sufficiency of my Estate for the support of my beloved wife Mary E. Copelan for and during her natural life, and at her death the same to revert back to my Estate and be equally divided among all my children and the children of any child that may be dead to stand in the same place the parent would if in life, it is my will and desire that my property be equally divided share and share alike among all my children and the children of any child that may be dead are to stand in the same place the parent would if in life in the distribution of my estate. Item 4th. It is my will and desire that my children from the eldest to the youngest should receive equal shares in every respect from my estate as I do not wish any one to receive more than another, and I wish all advancements at any time made or received by any child on any account to be strictly accounted for. Item 5th. I do hereby constitute and appoint my brother John Copelan Executor and my beloved wife Mary E. Copelan Executrix to this my last Will and Testament. In testimony whereof I have hereunto put my hand and affixed my seal on this the thirteenth day of November in the year of our Lord one thousand eight hundred and sixty three. J.N. Copelan Signed, sealed, declared and published by Janper N Copelan as his last Will and Testament in our presence, who have signed the same as subscribing witnesses thereto in his presence and in the presence of each other at his request this 13th day of November 1863. Winfield and Benjamin R. Crabbe, two of the subscribing witnesses to the within and foregoing last Will and Testament of Jasper N. Copelan, late of this county dec'd, who upon oath say that they saw Jasper N. Copelan the Testator sign, seal and heard him declare the same as his last Will and Testament, freely, voluntarily and of his own accord and without any compulsion whatever; that at the time of the execution of said Will said Testator was of sound and disposing mind and memory; that they, deponents, together with James. T. Hall and Philip B. Robinson signed said Will as witnesses in the presence of each other and in the presence of the Testator. Sworn to and subscribed in open court James W. Winfield December 7th 1863 Benjamin R. Crabbe Eugenius L. King, Ordinary State of Georgia Greene County We do solemnly swear that this writing contains the true last Will of the within named Jasper N. Copelan deceased, so far as we know or believe, and that we will well and timely execute the same in accordance with the lasw of this State. So help us God. Sworn to and subscribed in open court M.
