Harkins, deceased B. F. Trotter, Adm. of John Harkins, dec'd. to James R. Wyly Georgia, Habersham County This Indenture made this third day of September Eighteen hundred and forty nine between Benjamin F. Trotter, administrator of the Estate of John Harkins late of said County deceased of the one part and James R. Wyly of the County of Union in said State of the other part - Witnesseth that whereas by virtue of an order granted by the Honorable Inferior Court of said County when sitting for ordinary purposes on the first Monday in July last to said Benjamin F. Trotter administrator as aforesaid to sell all the real estate (widow's dower excepted) belonging to the estate of said deceased after having advertised the same in conformity to law did put up and expose to sale before the Courthouse door in said County on the first Tuesday in September eighteen hundred and forty nine within the legal hours of sale Lot of land situate lying and being in the eleventh district of said County known & distinguished in the plan of said district as lot of land number one hundred and thirty eight (138) containing two hundred fifty acres more or less when said tract of land was knocked off to James R. Wyly at the price or sum of five hundred and ten dollars he being the highest bidder. Now for and in consideration of the sum of five hundred and ten dollars in hand paid to the said Benjamin F. Trotter administrator as aforesaid by him the said James R. Wyly at and before the sealing and delivery of these presents the receipt whereof is hereby acknowledged said Benjamin F. Trotter administrator as aforesaid hath granted bargained and sold and by these presents doth grant bargain and sell unto the said James R. Wyly his heirs and assigns the said lot tract or parcel of land number one hundred and thirty eight in the eleventh district of said County with all the rights members and appurtuances thereto belonging or in any wise appertaining unto him the said James R. Wyly his heirs executors and administrators and assigns to his and their own proper use benefit and behoof forever in fee simple and the said Benjamin F. Trotter administrator as aforesaid the said bargained premises unto him the said James R. Wyly his heirs and assigns will warrant and forever defend the right and title thereof against the claim of all persons whatsoever so far as he may be bound to do either in law or equity as administrator as aforesaid. In witness whereof the said Benjamin Trotter administrator as aforesaid hath hereunto set his hand and seal the day and year above written. B. F.
