To Thomas Washburn Georgia } Habersham County} This Indenture made this third day of September Eighteen hundred and forty nine between Benjamin F. Trotter administrator of the Estate of John Harkins late of said County deceased of the one part & Thomas Washburn of the same place of the other part - Witnesseth that whereas by virtue of an order granted by the Inferior Court of Said County when sitting for ordinary purposes on the first Monday in July last to said Benjamin F. Trotter administrator as aforesaid to sell all the real estate (widow's dower excepted) belonging to estate of said deceased after having advertised the same in conformity to law did put up and expose to sale before the Courthouse door in said County on the first Tuesday in September Eighteen hundred and forty nine within the legal hours of sale, part of lot of land being in the East side and half of lot of land situated lying and being in the Eleventh District of said County known and distinguished in the plan of said district as the east part & half of land number one hundred and twelve (112) containing one hundred & twenty five acres, when said part of said lot of land was knocked off to the said Thomas Washburn at the price or sum of fifty nine dollars and fifty cents he being the highest and best bidder. Now for & in consideration of the said sum of fifty nine dollars and fifty cents in hand paid to the said Benjamin F. Trotter administrator as aforesaid, by the said Thomas Washburn at and before the sealing and delivery of these presents the receipt whereof is hereby acknowledged, said Benjamin F. Trotter, administrator as aforesaid hath granted bargain and sell unto the said Thomas Washburn his heirs and assigns the said part of lot of land number one hundred and twelve in the eleventh district of said County, with all the rights members and appertenances thereunto belonging or in any wise appertaining him the said Thomas Washburn his heirs executors administrators and assigns to his and their own proper use benefit and behoof forever in fee simple and the said Benjamin F. Trotter administrator as aforesaid the said bargained premises unto him the said Thomas Washburn his heirs and assigns will warrant and forever defend the right and title thereof against the claim of all persons whatever so far as he may be bound to do either in law or equity as administrator aforesaid.
