Harkins, 67-1/2 acres Benjamin F. Trotter, Adm., to Ruthy Harkins, Habersham Co., GA This Indenture made this third day of September in the year Eighteen hundred & forty nine, between Benjamin F. Trotter, administrator of the Estate of John Harkins, late of Said County, deceased, of one part, & Ruthy Harkins of the same place, of the other part, Witnesseth that, whereas by virtue of an order granted by the Inferior Court of Said County when sitting for ordinary purposes on the first Monday in July last to said Benjamin F. Trotter, administrator as aforesaid to sell all the real estate (widow's dower excepted) belonging to the estate of said deceased after having advertised the same in conformity to law, did put up and expose to sale, before the Courthouse door in said County on the first Tuesday in September Eighteen hundred and forty-nine within the legal hours of Sale, part of Lot of land situate lying and being in the eleventh district of said County, known & distinguished in the plan of said district as part of the South side of Lot of land number one hundred and twenty, containing sixty-seven acres more or less when the same was knocked off to the said Ruthy Harkins at the price or sum of fifty dollars, She being the biggest & best bidder. Now for and in consideration of the Said sum of fifty dollars, in hand paid to the said Benjamin F. Trotter, administrator as aforesaid, by the said Ruthy Harkins at and before the sealing and delivery of these presents the receipt whereof is hereby acknowledged, said Benjamin F. Trotter, administrator as aforesaid, hath granted, bargained, and sold by these presents, doth grant, bargain & sell unto the said Ruthy Harkins her heirs and assigns the said part of lot of land being part of lot of land being part on the South Side, numer one hundred twenty, containing sixty seven acres more or less in the Eleventh district of Said County, with all the rights, members and appurtenances thereunto belonging or in any wise appertaining unto her the said Ruthy Harkins, her heirs, executors, administrators and assigns to her and their own proper use benefit & behoof forever in fee simple & the said Benjamin F. Trotter, administrator as aforesaid the administrator promises to her the said Ruthy Harkins her heirs and assigns will warrant and forever defend the right and title thereof against the claims of all persons whatever so far as he may be bound to do either in law or equity as administrator of aforesaid, hath hereunto set his hand and seal thie day & year above written.
