Odell of said place of one part and Martha W. McCleskey wife of George W. McCleskey and her children of the other part. Witnesseth that the said John E. Odell for and in consideration of the love and affection he has for the said Martha W. McCleskey and her children and the desire he has to provide a home for her and her presence and future family if the same should increase has given and granted and does by this writing give grant convey and confirm to the said Martha W. McCleskey and her children present and future all that tract or parcel of lands being and situated in said county of Hall and known as the South East half of Lot No. 66 Sixty Six in the Eighth District of said county containing one hundred and twenty five acres, and bounded by lines and courses as follows by joining lands of John Jenkins on the East, John W. Reed on the South and Starling Roberts on the North side. To have and to hold to the sole use and benefit of the said Martha W. McCleskey and her children as aforesaid with all the rights members and appurtenances thereunto belonging forever with the qualifications and conditions following to wit. That if George W. McCleskey, the husband of said Martha W. McCleskey should never return from the Rocky Mountains where he is now absent on an adventure for Gold, this conveyance to be absolute for the purposes aforesaid and should the said George W. return and refuse to accept the land to live on it as a home for his family, then the same to revert to the said John E. Odell and the decision to be made by said George W. within twelve months after his return from the Rocky Mountains but his decision not to control the said Martha if she desires to accept it on the terms aforesaid and should they both refuse the land with the limitations aforesaid then the same to revert to the said John E. Odell or become a part of the estate and be subject to the dispositions of his executors according to the terms of his will. In witness whereof the said John E. Odell has signed sealed and delivered this writing in the presence of us, the 20th day of September 1861. Berry Bagwell John E. Odell (LS) Ralph S. McCleskey and her children a certain light C Sorrel mare five years old last Spring and her increase subject to the limitations and qualifications contained in the foregoing conveyance---In witness whereof said Odell has signed sealed and delivered this writing in the presence of us this the 14th day of October 1861.
