McCleskey of said State and County of the first part and Elenezer N. Gowen of the same place of the other part---Witnesseth that the said Benjamin G. McCleskey for and in consideration of the sum of six hundred dollars to him in hand paid by the said E.N. Gowen the receipt whereof is hereby acknowledged does by these presents give grant bargain sell and convey unto the said Ebenezer N. Gowen his heirs and assigns the one half of my mining interest that I own in the number four (4) and five (5) in the Eight District of Hall County being the fourth interest in said lots in said county. They being the place whereon the pounding mill stands including the gold mine containing forty three acres and a fourth and the other tract adjoining the above it being part of lot no five in said district containing forty acres more or less. The first bounded as follows beginning at a Stake corner to M. Martins land and running thence N. 45 E. 23 chains to a post oak thence N 68 W 24 chains to a red oak thence N 49 W 17 chains to a post oak on the east side of the creek thence N 62 1/1 W 4 chains and 50 links to a chestnut tree on said Martins lines and with said line to the beginning corner. The other place bounded as follows beginning at a stake corner of Mr. Martins lot it being also a corner of the tract first above named and running thence N 45 East a dogwood opposite the corner of William Praters field thence in a Southern direction on the outside of said field to a post oak where the fence runs a Southeastern direction thence a straight line in the direction of the fence until it strikes a post oak on the line of said lot thence S 45 W to the Original corner of said lot thence along the line of said Lot no 5 to the beginning corner. Also the said E. N. Gowen is to have a half of my interest in the water privilege at the river and the privilege of a road from the mine to the river and is to a half interest in the timber on the place to have and to hold said tracts or parcel of land unto him the said Ebenezer N. Gowen his heirs and assigns together with all and singular the rights members and appertenances thereof to the same in any manner belonging to his and their own proper use, benefit and behoof forever in fee simple. And the said Benjamin G. McCleskey for himself his heirs executors and administrators the said bargained premises unto the said Ebenezer N. Gowen his heirs and assigns will warrant and forever defend the right and title against themselves and against the claims of all other persons whatever in witness whereof the said Benjamin G.
