Between James Hurley of the County and State aforesaid of the one part and Robert Stribling of the same place of the other part. Witnesseth that the said James Hurley hath this day made and delivered to the said Robert Stribling his certain promissory Note Subscribed with his hand and bearing even date with these presents hereby the said James Hurley hath promised to pay the said Robert Stribling or bearer Three Hundred and Thirty Dollars and Sixty Cents on or before the twenty seventh day of October next ensuing the date hereof for value received. Now for and in Consideration of the sum of Five Dollars by the said Robert Stribling to the said James Hurley in hand paid the Receipt whereof is hereby Acknowledged as well as for the better securing the payment of the aforesaid promissory note the said James Hurley hath Granted Bargained and Sold and doth by these presents Grant bargain and Sell unto the said Robert Stribling his Heirs and assigns all that Tract or parcel of Land situate lying and being in the said State and County and known and distinguished in the place of said County as Lot No One Hundred and thirty Six in the Eighth District of said County Containing One Hundred thirty five Acres, also One hundred Acres more or less. Beginning at a corner post Oak on William Brannons line and running on said line to a Chestnut Corner, thence along Sherwood James line to a Corner Chestnut, thence a strait line to a Post Oak Corner, thence along the Ridge to the beginning Corner Post Oak with all the rights members and appurtenances to the said Lot of Land in anywise appertaining or belonging to have and to hold the said bargained premises unto the said Robert Stribling his heir and assigns to his and their own proper use benefit and behoof forever. And the said James Hurley for himself his heirs Executors and Administrators the said Bargained Premises unto the said Robert Stribling will Warrant and forever defend against the claim of himself and his Heirs and against the claim of all other persons whatsoever . Provided nevertheless that it the said James Hurley his Heirs Executors and Administrators shall and do well and truly pay or cause to be paid unto the said Robert Stribling his heirs and assigns the aforementioned sum of Three Hundred and thirty Dollars and Sixty Cents on the day and time mentioned and appointed for the payment thereof in the said Promissory Note mentioned with lawful interest for the same, according to the Tenor of the said Note, then and from thenceforth as well this present indenture and the right to the property thereby conveyed as the said promissory note shall cease determine and be void to all intents and purposes.
