This file was contributed and copyrighted by: Doug Miller <> ================================================================================ June 2000 Last Will and Testament of Neverson Cook, Hall County, GA, 28 March 1856 I, Neverson Cook, in view of my bodily affliction and infirmity of age feeling satisfied that I have not long to remain in this life but feeling possessed of composed mind and memory do in the name of Almighty God and in the presence of these witnesses make this my last will and testament. First of all, I desire to commend my soul to God who gave it, and my body to its mother dust, 2nd, I will and bequeath to my beloved wife Margaret Cook during her life or widowhood only, the plantation whereon I now live and my Negro family, Bart, a Negro Man, and Susan, a woman and her five children, Mariah, Benny, Jasper, Lea, Albert. Household and kitchen furniture necessary for comfortable living. Also my stock of cattle, oxen, and wagon, my young horse, buggy, and smith tools all of which she may possess during her life or widowhood only. 3rd, After paying my just debts I will and bequeath to my three daughters Mahaley, Nancy, MaryAnn and Frances M. Cook each one hundred dollars for the purpose of making them equal with what my other sons have already had. 4th, I will and bequeath to all my beloved children at the expiration of the above life or widowhood of my said wife my entire estate then remaining to be divided among all my children equally, my daughter Mahaley to possess her part, during life or widowhood, then to go to the heirs of her body equally, 5th, I also desire that, provided my son F. M. Cook do not return from California that my son Wm. H. Cook make out his account against my son F. M. Cook and that the said account be paid out of the part of F. M. Cook 6th, I also will that at the expiration of the life or widowhood of my beloved wife that provided my heirs Mahaley Hardage, Jeditha Cook, Nancy Martin, Mary Ann Hardage, W.H. Cook, James M. Cook, F. M. Cook cannot agree on a distribution of my property that they choose referese (referees) for the purpose of making an equal division (to) the above heyrs (heirs) without putting my property to sale, Lastly, I appoint my son W. H. Cook and Jonathan Martin my executors to this my last will and testament who I deem trustworthy to the duties of the same. Given under my hand and seal this the twenty-eighth day of March 1856.
