Recorded: January 1867 In the name of God Amen I Jacob Brooks being afflicted in body but of sound mind and memory Thanks be to God for the Same. I give and bequeathe unto my beloved wife Elizabeth Brooks one negroe woman named Sarah, also one negroe man by the name of Stephen. Two feather beds, bedsteds and cloathing for the same. One good plow horse. Two milk cows of her own choosing. Ten head of hogs of her own choice. One chest, one table, one slab with all the glass ware with other wares of crockery and earthen wares that is usually kept on said slab, one safe and kitchen furnature, a sufficiency of her own choice in quantity and quality. Also the tract of land where on I now reside including my dwellings, housess and kitchen, also as much of my farm as she may need to make a support to full sufficiency during her lifetime or widowhood. I give and bequeathe to my son Zemry Brooks one tract of land in Gwynett County Georgia worth $400 also $100 in money which he has received and is a portion of his distributive share of my estate. I give to the children born in lawful wedlock of my son Esaw Brooks one tract of land whereon himself and family now resides in the county of Hall, State of Georgia worth $500 which they have received and is a portion of their distributive share of my estate. I give to my daughter Eady Brooks who intermarried with John Henderson one negroe boy named Jackson worth $500. Said negroe to be the property of my said daughter Eady for and during her life and at her death to go to and become the property of her children all having equal rights. To son John Brooks one tract of land lying in Banks County, Georgie whereon he now resides worth $500. I also give to my son James Brooks $236 which he has received and is a portion of his distributive share of my estate. I give to my daughter Sarah M. Brooks who intermarried with William T. Ritcheson now Sarah M. Ritcheson one negroe girl named Mariah Jane worth $500 also $346 in money which is to be paid to my daughter Sarah M. Ritcheson at my death. To my son Moses Brooks one tract of land lying in Banks County Georgia whereon he now resides worth $500. I also give to my son Moses Brooks $36 which he has received both the land and the money and is a portion of his distributive share of my estate. To my daughter Rebeca Brooks who intermarried with Azmon Rucker, now Rebeca Rucker, one negroe boy named Lumpkin worth $500 and which she is to have during her lifetime and at her death go to and become the property of her children by her present or future husband and all her said children to have equal rights in said negroe. To daughter Mary Brooks who intermarried with Andrew Hendrix one negroe girl named Martha worth $500 which said daughter Mary Hendrix is to have and use during her life and at her death go to and become the property of her children to have equal rights in said negroe girl and her increase. To son Jacob M. Brooks the right of possession to and of using so much of his said farm as may be needed for the support of himself and family during the lifetime of him and his wife and after the death of his wife said tract of land whereon I now reside it is my will and desire said land shall be the property of my son Jacob M. Brooks with all the rights members and appurtenances therto belonging in manner whatever. To daughter Sultana Brooks who intermarried with James Bell, siad Bell having departed this life, Sultana having since that time intermarried with one James L. Waters, now Sultana Waters, one negroe girl named Harriet worth $500, also one cow and calf which they have received during her lifetime and after her death to go to and become the property of her children as well the children she had by James Bell or the children she may have by the present or any future husband all having equal rights in siad negroe with all its future increase to daughter Sultana Waters one negroe boy named Daniel worth $595 which daughter Sultana has received. To daughter Elizabeth C. Brooks who intermarried with William A. Ellison, now Elizabeth C. Ellison, one negroe girl named Dinah during her lifetime to his daughter, after her death to go to and become property of her children. To children of daugher Margaret F. Brooks who intermarried with William W. Smith now Margaret F. Smith one negroe boy named Fredrick with all his future increase to be equally divided between the children of his daughter. To daughter Margaret F. Smith $220 which she has received. To son David Brooks one tract of land in Jackson County Georgia worth $500. To each of his sons-in-law following sums of money annexed to their names to wit. John Henderson $100, Andrew Hendrix $100, Azmon Rucker $100, W. A. Ellison $100, William W. Smith $100, William W. Waters $100. Executors: Sons, Moses Brooks and Jacob M. Brooks Witnesses: Hosea C. Giddens, James H. Davis, Enoch Anderson and Harvey R. Anderson. Additional Comments: Jacob Brooks was born 4 NOV 1776 in North Carolina and died 3 JAN 1867 in Jackson County, Georgia. He is also listed in the 1809 Tax Digest for Jackson County, page 53.
