Colquitt Thomas Colquitt & Benjamin Colquitt of the State & County aforesaid of the one part & Robert Freeman of the County of Oglethorpe & State aforesaid of the other part. Whereas the Said John T. Colquitt Thomas Colquitt & Benjamin Colquitt have made & executed there in instrument in writing commonly Called A Promissory Note subscribed with their own hands & bearing even date with these presents—Whereby they the Said John T. Colquitt Thomas Colquitt & Benjamin Colquitt or either of them promise to pay unto the Said Robert Freeman or bearer on or before the first day of November next & ensuring the date thereof the Sum of three thousand three hundred & twenty eight Dollars & twenty five Cents for value received as in & by the Said Recited note relation being thereunto had more fully & at large appear . Now this indenture Witnesseth , That the Said John T. Colquitt Thomas Colquitt & Benjamin Colquitt, as well for & in consideration of the aforesaid Debt or Sum ( of money ) of three thousand three hundred & sixty eight dollars & twenty five Cents & for the better securing of the payment thereof unto the Said Robert Freeman his executors, administrators & assigns in discharge of the Said recited Note as of the further Sum of one dollar to them in hand paid by the Said Robert Freeman at & before the Sealing & delivery hereof, the receipt whereof is hereby acknowledged have granted, bargain , Sold delivered & conveyed & by these presents do grant –bargain Sell deliver & convey unto the Said Robert Freeman his heirs & assigns Twelve Negroes Names & age as follows (viz) Harry of the age of thirty five Years Doctor of the age of eighteen Years Dick of the age of eighteen Years York of the age of eighteen Vilet of the age of Forty Years Sall of the age of Forty Years Abagal of the age of twenty four years Milly of the age of twenty five Moll of the age of thirteen Years little Hary of the age of twelve Years Diner of the age of twenty four Years Hannah of the age of five Years. To have & to hold the Said Negroes together with their increase unto the Said Robert Freeman his heirs & assigns to the only proper use & behoof of the Said Robert Freeman his heirs & assigns forever, And we the Said John T. Colquitt Thomas Colquitt & Benjamin Colquitt & each of us the aforesaid Negroes against ourselves our heirs & against the claim or claims of all & every person or persons whatsoever unto Book K page 7 To the Said Robert Freeman his heirs & will Warrant & forever defend— Provided always Never helps that if the Said John T. Colquitt, Thomas Colquitt & Benjamin Colquitt their heirs executors or administrators Shall & do well & truly pay or cause to be paid unto the Said Robert Freeman his executors administrators or assigns the aforesaid debt or Sum of three thousand three hundred & sixty eight dollars & twenty five Cents, on or before the first day of March eighteen hundred & twelve with lawful interest for the Same, without any fraud or further delay & without any deductions, defatcation or abatement to be made of any thing for or in respect of any taxes, charges or assessments whatsoever then & from thence-forth as well this present indenture & the estate & interest hereby conveyed & granted in the Said Negroes, as the Said recited Note Shall cease , determine & become absolutely null & void to all interest & purposes anything herein before contained to the contrary in any sense notwithstanding.
