This file was contributed by: Clark Forrest, Jr. ecforrest@charter.net ==================================================================== Benjamin and William HUTCHINSON Sale of Land Hancock Co., Georgia 27 December 1797 This Indenture made this twenty seventh day of December in the year of our Lord, one thousand seven hundred and ninety seven, and in the twenty second year of American Independence, between Benjamin & William Hutchinson of the State of Georgia & County of Hancock of the one part, and James Yarborough of the junr. of the aforesaid State and County of the other part. Witnesseth that the said Benjamin & William Hutchinson, for and in consideration of the sum of thirty pounds Sterling money of said State to him in hand paid by the said James Yarborough junr., the recept whereof they the said Benjamin & William Hutchinson Doth hereby acknowledges themselves to be fully satisfied, contented and paid. Hath given, granted, bargained, sold, alliened, enfeoff, released and confirmed, and by these presents doth convey and confirm by these presents doth set over unto the said James Yarborough junr. his heirs and assigns forever, a certain tract or parcel of Land containing one hundred and ____ twenty acres, situate, lying, and being in the County and State aforesaid on the East side of the Oconee river Beginning at a Willow oak on the bank of sd River, and runs South 65. E. 37 chain and 25 links to a Red Oak joing Biram's Land; thence South 26. W. 41 chain to a Hickory joining said Hutchinson's Land; thence W. 16 chain and 50 Link's to a Post Oak, unknown Land, No. 52, chain to the beginning Thurraman's Land. To have and to hold the aforesaid tract of land with all and singular the rights, members, and appurtenances thereof, whatsoever, to the said tract or parcel of Land belonging or in any wise appertaining. And allso all the Estate, right, title, Interest, claim and demand of him the said Benjamin and William Hutchinson of, into, or out of the the said tract or parcel of Land; and all & singular the premises aforesaid, with their every of their rights, members, and the appurtenances, unto ^ the said James Yarborough his heirs and assigns, to his and their own proper use, and behoof forever, warrant and forever defend the same from all manner of person or persons whatsoever- In Witness whereof they sd Benjamin & William Hutchinson hath hereunto set their hands and affix'd their Seals the day and date above written.-- Signed Seald & delivered Benjn Hutchinson L?S In the presents of William Hutchinson L?S Robert Finch his Absolum Tralor X mark Georgia Hancock County This day Absolem Traylor personally appeared before me, John Ragan one of the Justices appointed to keep the peace in said County and made oath that he saw was a subscribing witness To the within Deed, and also saw Benjamin Hutchinson & William Hutchinson sign, seal, and deliver the within Deed to James Yarborough for the use within mentioned; and also Robert Finch subscribe as a witness to the same sworn to before me this fifth day of January 1798. his John Ragan J.P.
