Smith of the county and state aforesaid of the one part, and Frederick Barefield of the other part, of the same place. Witnesseth, that the said John E. Smith hath, on the 29th day of December 1829 made and delivered two certain promissory notes an [one] payable to Silas Plunket or bearer for one hundred and eighty seven dollars & fifty cents, & payable the 25th of December 1830 signed by said Smith & the sd. F. Barefield as security, also one other note for one hundred and eighty seven dollars and fifty cents payable to F. & D. Barefield & payable the 25th Decmeber 1831. Now for and in consideration of the sum of five dollars by the said Fredrick Barefield to the said John E. Smith in hand paid, the receipt whereof is hereby acknowledged, as well as for the better securing the payment of the aforesaid notes, the said John E. Smith this day granted, bargained and sold, and doth by these presents grant, bargain and sell unto the said Fredrick Barefield his heirs and assigns, an lot whereon the said Smith now lives together with all and singular the members and appurtenances pertaining to said lot, it being one acre more or less, lying near Mt. Zion Academy adjoining the land of Gilbert and Thomas. To have and to hold said bargained property to the said Fredrick Barefield, to him his heirs, to his own proper use benefit and behoof forever, and the said John E. Smith, for himself his heirs executors and administrators the said bargained premises unto the said Frederick Barefield will warrant and forever defend against the claim of himself and his heirs and against the claims of all other persons whatever, Provided nevetheless that said John E. Smith, himself, his heirs executors or administrators shall and do well and truly pay or cause to be paid the said described notes and all interest, costs &c which may or shall accrue on them, Then and in that case the above indenture shall cease and be void, otherwise to remain in full force and virtue.
