Thence to William Rabun leaving his house in the 15th Regt. Thence to Joel D Newsoms leaving his house in the 15th Regiment thence to the Pony Wood house leaving it in the !4th Regt. Thence to Samuel Ransom leaving his house in the 15th Regt. Thence to George Culver leaving his house in the 14th Regt. Thence to Samuel Ewings leaving his house in the 14th Regt. Thence to the east end of Broad Street , Sparta ( now Jno. T. Mapling Shop ) thence up Broad Street to the center of Rabun Street—thence along Raburn Street to the muster grounds (around & about the female academy as is now ), thence the road through the muster grounds to ------ Abercrombie leaving his house in the 14th Regt.thence to George Hamilton leaving his house in the 14th Regt –(End of page, Description cont. on next page, also not numbered ). One day after date we promise to pay Benjamin Wilson. Thence to Epps Brown leaving house in the 14th thence a straight line to Charles W Donald leaving his house in the 14th Regt. Thence by Ragans old place leaving it in 14th Regt. To John Daniels Granny ( Ben Butts place ) leaving said Daniels house in the 14th Regt. Thence S 44’ 30 E 102 chains to Buchannom old place thence to the Baldwin County line. ( page number one partially torn and rest not readable ). Smith----------------------two dollars------$2.00 Fountain Blankenship--------------two dollars-------$2.00 No return of the delinquents of the volunteer company of artiltillery has been made Capt Hudson’s list of delinquents, who failed to appear at the last general Muster of the 28—29th militia being produced and it appearing to the court , that they were not legally notified to appear at said Muster . The court therefore were of opinion they be not fined Capt. Simmons Sen. Having produced his list of delinquents, who failed to appear at the last general Muster of the 28—29th militia—and it appearing to the court, that they were not legally notified to appear at said Muster the court therefore were of opinion that ( page---6 ) be not fined Capt. Wynn’s list of delinquents were not produced, the time being too far advanced, when Capt. Wynn, was about to g ive his order respecting the last Regimental Muster agreeable to law- ---notwithstanding Capt Wynn Mustered his company –who were possessed with the spirit of patriotism and a regard for the laws of their country, voluntarily turned out – and made a respectable parade, therefore the court deemed it unnecessary---- -- to require of Capt. Wynn a list (if any) of those who failed to appear at said Muster Capt. Butler and Capt. Williams did not produce a list of the delinquents in their respective companies--- neither of them having his company properly arranged nor legally notified---owing to their appointment being ------to the time prescribed by law when they should be notified there fore made no return Capt. Graybill’s list of delinquents who failed to appear at the last general Muster of the 29th militia were produced----- Neither Captain Graybill, secretary, and sergents attended the Court to justify that the delinquents were duly and legally notified to attend this Court agreeable to law---Heretofore ordered that of the delinquents ( page---7 ) be made –in order that they may be brought to trial agreeable to law---the names of the delinquents certified by Capt. Graybill are as follow, that is to say Joseph Grimesley Lieut. Wylie Patterson Richard Grimesely Corpl Philip Stevens John Marchman Philip Dunn Edmound Templin Jesse Mollet Thomas Glynn James Mollet Robert Freny William Cain The Court took into consideration, the proceedings of the last Battalion Court of Enquiry for the 25th Battalion of militia, held at the house of Captian Henry Trippe on the thirteenth day of April one thousand eight hundred and four---and whereas the members of said Court were not Properly provided with the state Militia law or duly informed of the legal steps they should possess This court therefore are of opinion that the proceedings of said Court of Enquiry of the 13th April 1804 be made null and void, and the fines assessed by said Court, on delinquents be and is omitted Ordered, that a copy of this insofar as relates to the proceedings of this said Battalion court of enquiry of the 13th April 1804, be served on the clerk of said court--- in order that may be inserted on the record of said Battalion Court of Enquiry ( page---8 ) The court took into consideration what should be a compensation for serving of the Clerk , paymaster, and Provost Marshall---Whereupon the Court proposed the following resolution, viz. Resolved, That the salary of the Clerk be four dollars , a day for each day he is called to do the duty of his office and attend together with the fees allowed by law for giving warrant of list of , and find his own books and stationary Resolved, that the Paymaster shall have five percentum on all money received and paid by him, which shall be a full compensation for his serving Resolved, that the salary of the Provost Marshall be two dollars a day when he is called to his duties of his sation, and performs the same Resolved, That the salary of the Drum Major and Fife Major be two dollars a day each, for every day they are called to perform the duties of their respective sation Joshua Spivy, Absalom Traylor, Thomas Dollard, Newbill Waller, William Waller, Planner Shores and George Mattox, were returned delinquents by their respective Captains, and after being duly and regularly called into court and the usual oaths ( page –9 ) Edmund Butler ) Henry Brown ) James Waller ) Members John Weeks ) Chappell Sledge Leuit Com. ) Harris Brantly Provost Marshall James H. The court being opened in due form, the oath required by law was duly Adminstered to Duke Hamilton, Alexander Bass and Henry Brown, by John----- Justice of the Inferior Court Andrew Baxter, Sargent to Capt. Hamilton company of Matrass, being duly returned and Called as to delinquent on the 6th in so for not attending a muster of Officers was fined one dollar William Whitfield Sargt. To Capt. John Simmons company being duly returned and called as to Delinquent for not attending the Muster of Officiers on the 6th in so was fined three dollars The oath prescribed by law was duly administered to Chappell Sledge by Duke Hamilton Esq. Joseph McGinty Sargeant to Capt. Graybill’s company being duly returned and called as to Delinquent for not attending the Muster of Officers on the 6th in so, fined three dollars ( page----10 ) James Perdue Sargt. To Capt. Graybill’s company being duly returned and called as a delinquent for not attending the Muster Of Officers on the 6th in so was fined three dollars Francis Gray Sargt. To Capt.
