Latimore The last will and testament of Thomas Mathis late of the County, deceased, being produced in open Court, and the legal executors thereof by said testator being shown to the satisfaction of the Court by the evidence of William M. Boyer, Stephen Pearson and Solomon Robinson the attending witnesses thereto - It is ordered that said last will and testament be recorded and that the nominated executors be qualified on their application. WILL OF THOMAS MATHIS, Hancock Co., GA Will Book M, pp. 524, 562 In the name of God Amen, I Thomas Mathis of the County of Hancock & State of Georgia, being of Sound & disposing mind & memory, but calling to mind the uncertainty of Human life, do make & ordain this my last will & testament in manner & form as follows.. First It is my will & desire that my body may be decently intered in a Christian like manner & that my funeral expenses & all the just debts which I may owe at my death may be paid out of my estate- Then all the property which I have heretofore delivered to each & every of my children I hereby give and bequeath to ____ to ____the same has been delivered respectively their heirs & assigns forever- Item - I give and bequeath unto my daughter Sally Chappell a certain Negro boy named Anthony her heirs & assigns forever- Item - I give & bequeath unto my daughter Dorothy Minter a certain Negro boy named Peter her heirs & asigns forever - Item - I give & bequeath unto my daughter Nancy Mathis a certain Negro boy named Tony? her heirs & assigns forever - Item I give & bequeath unto my son Gabriel Mathis a certain Negro girl named Maria his heirs & assigns forever, and the sum of fifty dollars in cash at my death - Item I give & bequeath unto my son John Mathis' orphans a certain Negro girl named Dilly them & their heirs & assigns forever & fifty dollars in cash at my death. Item I give & bequeath to my daughter Martha Cox a certain Negro boy named Martin her heirs & assigns forever & one hundred & sixty dollars in cash at my death - Item I give & bequeath to my daughter Eliza Hunter a certain Negro girl named Rhoda her heirs and asigns forever & one hundred & seventy five dollars in cash at my death - Item I give & bequeath unto the children of my daughter Polly Boland which may be in life at the time of my death, one Negro girl named Juda & one hundred dollars in cash & also the tract of land which I purchased of John Thomason leaving it discretionary with my executors herein after named to sell said tract of land & purchase other property for the benefit of said children; & also in their discretion to appropriate the use & benefit of said Negro & land to the support & maintenance of my said daughter Polly Boland during her natural life or for a shorter period if they think proper. Item I give & bequeath unto the orphans of my son Charles Mathis dec'd three hundred & fifty dollars at my death to be divided among them share & share alike - Item I give & bequeath unto the orphans of my son Robert Mathis dec'd three hundred & fifty dollars in cash to be divided among them share & share alike - Item It is my will & desire that all the residue of real & personal property of which I may die siezed and possessed after paying my just debts & the cash legacies mentioned in this will may be equally divided among my children & grand children in ten equal shares according to the Laws of distribution in force in this state reserving to my Executors the power to appropriate the one tenth part which I specially give & bequeath to the children of my daughter Polly Boland in such manner as to afford to my said daughter the use & benefit of the same for such length of time as my said Executors may in their discretion think proper. Item I give & bequeath unto my son in law John Boland twenty dollars & no more. I hereby nominate constitute & appoint Gabriel Mathis, Elisha Mathis, and John M. Minter my executors to this my last will & testament hereby revoking all former wills by me made & executed - as witness my hand and Seal this 2 June 1824 - Thomas Mathis (Seal) Acknowledged in presence of William M. Boyer J.P. Stephen Pearson Solomon Robinson Gabriel Mathis, Elisha Mathis & John M. Minter nominated executors of the last will and testament of Thomas Mathis, appeared personally in Court and were duly qualified as executors of said will. Whereupon it is ordered that letters testamentary do issue to them as Executors - On the application of Gabriel Mathis, Elisha Mathis & John M. Minter Exors. of the will of Thomas Mathis dec'd. It is ordered that William M. Boyer, Stephen Pearson, Elias Boyer, John Minter, & William S. Hamill? be and they are hereby appointed appraisers of the personal property of said dec'd and that they or any three of them being first duly sworn do appraise said property and make return thereof to said Exors. according to Law.
