Will Book N (1829-1827) Last Will and Testament of Green Shell written 20 Feb 1834 and probated 7 Nov 1836 Georgia Hancock County Inferior Court sitting for Ordinary Purposes, Monday 7th November 1836 Present their Honors Joel Crawford Wilson Bird Justices John W. Rabun The last Will and testament of Green Shell late of this County dec. being produced in Court and the due and legal execution of said Will and Testamentary paper and that said Shell was at the time of executing the same and disposing mind being proved to the satisfaction of this Court by the evidence of William Jones one of the attesting witnesses thereto- it is ordered & considered by the Court that said Will is duly proved as a testamentary paper and that it be recorded. Georgia Hancock County In the name of God Amen I Green Shell of the County and State aforesaid being in perfect mind, though in feeble health and believing that it is appointed for all men once to die and believing that I am destined to go with the rest of the world; I have thought proper to make this my last Will. First. It is my request that my body after be intered in a decent manner. Secondly. I desire that all my just debts be paid. Third. I wish the balance of my property after paying my debts delivered over to my Wife Polly Shell & remain in her possesion during her life or widowhood, after her death or marriage my property to be equally divided between all my children. Fourth. if there should be money enough in hand and debts enough due to pay up all the debts against me, then and in that event my Executors will proceed to advertise such property asking in their judgement may be best spared and proceed to sell the same, or so much thereof as will be sufficient to pay any debts. Fifth. In order to carry out the provisions of this Will in operation, I constitute and appoint Francis T. Colley and John H. Lewis my Executors. Sixth. In the final division of my property it may be so that an equal division cannot be made among my children, without a sale of some of my property, then and in that case my wish is that my Executors proceed to ad­vertise and sell the same so that an equal division may be made. Seventh, When a sale is made of any of my property my request is that it be of the personal kind, if it can be done without damaging my estate, but in this particular as perhaps in some other matters of management I shall have to rely upon the judgement of my Executors. Eighth. Lastly I request that my Executors so soon as I am dead proceed to the settlement of my estate & turn over the balance of my property to my Wife Polly Shell who has the right to use it as before stated.
