March 1851 Jessie Lockhart - last will and testament I, Jessie Lockhart, of said County [Hancock] being of sound and disposing mind & memory & desirous of disposing of my property and estate in such a manner as I concern will be beneficial to my children do make and declaim the following as my last will and testament. I direct that any just debts that I may owe be paid from money in hand or from sales of property herein directed to be made and in the event that my death shall occur when a crop shall be on the land, I direct that it be perfected. I direct that all the real estate whereof I may be seized by sold at some convenient time or times as the qualified Executors shall determine and on such terms and in such manner whether by public or private sale as they may deem expedient and to this and I authorize the Executors hereof and such as qualify an ? to sell said real estate and make titles thereto. I also direct the sale of all my perishable property not herein otherwise disposed of by public sale and on reasonable credit. The proceeds of said sales deducting the expenses thereof to be equally divided between my sons, Richard and Robert. If my son, Robert, shall have been educated and if he shall not have been educated at my decease, five hundred dollars of such proceeds shall be set apart for the completion of his education and the residue to be divided equally as aforesaid. I give and bequeath to my son Richard, the Brass clock, two beds, bedsteads, & the ? furniture, and one trunk. I give and bequeath to my son, Robert, the desk formerly belonging to his grandfather with the letters E R [hope I'm reading this correctly] inscribed, my watch, two beds and bed steads, including the tester bedstead, the usual bedding and one trunk. I give and bequeath to my daughter, Rebecca, a trousseau and the Piano with two beds, bedsteads, and the usual furniture thereof, the silver tablespoons in use in my family, one plated candlestick, one half of the other candlestick, and one candle stand, two bedsteads and the usual furniture. I give and bequeath to my daughter Carmina ? Dennis, negroes Lucy, Caroline, William, Toliver, Irnea, Augustus & Joe and the increase of the females hereafter to be born and which are now in the possession of herself and husband on loan. Also Anthony now in my possession and I give to her husband, John Dennis, the note of three hundred dollars that I hold on him. I give and bequeath to my son Richard as Trustee for sole and separate use of my daughter, Aramenta, negroes old Henry, Daniel, the oldest Elsey and Louisa with the future increase of the females herafter to be born to hold in trust for separate use of my daughter during her life and on her decease given to her present child and any future issue of my Daughter the labor and profits of which slaves to be applied to the maintenances of said daughtere and of her child and its education and also of any future child. I give and bequeath to my daughter Rebecca the following slaves: Alfred, Young, Henry, Lizzy, her child, Celia, Elbert, Irwin and Retta and her two children, Mary Ann and Milly Ann and also an other child named not recollected and the increase hereafter to be born. I give and bequeath to my son, Richard, the following slaves: Ned, Jacob, Adam, Sims, Ransom, Daniel, son of Amelia, Hamas and her child, Massr ?, Amelia, Sally, Betsey, Polly, Delia, child of Amelia, Rachel, Micajah, Francis, & Elisa and their increase hereafter to be born. I give and bequeath to my son, Robert, the following slaves, Shad, Bury, Nathan, Jim, Emmanuel, Dorcas and her child Surry, Mana and child John, Adelia, Daniel, Ivy ?(Jerry?), Ellie, Amelia child of Delia, Minera, Harriet, Sain, Jerry, Charity, Roburs ?, and Martha and their increase of said females hereafter to be born. I direct and required that negro woman Silia shall be well and comfortably supported during life by my two sons and all the rest & residue of my estate of whatsoever virtue and dis ?, I give and bequeath to my said son a in equal proportion and they shall pay what debts I may owe at my decease. I constitute my son Richard Guardian of the person and property of my son Robert should I depart this life before Robert shall attain full age. Should either of my sons die underage & unmarried, I direct that his portion shall go to the surviving ? the and if either shall die after marriage and without a child born to be born within competent time, I direct that one half of his portion shall be and remain the right of his widow or such person or persons whoever he may appoint by will or declaration in writing in nature of a will and the other half be given to his surviving Brother but if such son so dying shall leave a child or one to be born to him after death the full portion herein given him shall he deceased vested fully and directly. I constitute my son Richard and my good friends Charles Dougherty and James A. Merriwether, Executors of this my last will and testament hereby revoking all former wills by me made. In witness whereof I have hereto subscribed my name and set my seal this 24th March 1851. Jesse Lockhart Signed, sealed and delivered by the testator to be his will in our presence have hereto subscribed our names, Intertermations & names before Executors. Anthony, Henry in place of Harry & her child & her two Children, Mary Ann and Milly Ann and also another child named not recollected. [Note previously the name was written Retta, not Harry] T ? Hawdas?, Henry Rodgers, Nathan C. Logan ? Lague? Be it known that on the 2nd day of Sept 1851, I, Jesse Lockhart, being still of sound mind and disposing mind and memory do make the following codicil to the foregoing will. First, I withdraw from the bequeathed to my son, Robert, the Negro Bury,and instead thereof I give & bequeath to him the negro Tom, recently purchased of the Warthen family and I give and bequeath to my son, Richard said Negro Bury. Secondly, I direct that the Negro Henry above given to my son, Richard in behalf of my daughter, Aramenta and now in Wanbenton? be sold by the Executor of this will and the proceeds of this sale be paid to my son, Richard as Trustee for my said daughter, and be by him kept at interest or invested in State Bonds or stocks to be ? by her in the same manner and subject to the same trust as expressed in the above bequest in himself. Given under my hand and seal this day, 17th Sept, 1853. Recorded in Clerk's office of the Superior Court of Taylor County pg 373, 374, 375. Additional Comments: I'm not sure why this was recorded in the Taylor Co Deed Book A.
