Will of Frances Hines 31 Jan 1870 Harris County, GA Harris Co., GA, Will Book 3, pp. 69-70 Georgia Harris County In the name of God Amen. I Frances A. Hines of said state and county being of sound and disposing mind and memory and knowing the uncertainty of life and certainty of death deem it right and proper both as respects my family and myself that I should make a disposition of the property with which a kind providence has blessed me. I do therefore make this my last will and testament, hereby revoking and annulling all others by me heretofore made. First I desire and direct that all my just debts (if any) be paid without delay by my executors hereinafter named and appointed. Secondly I give bequeath and devise to my beloved sons Thomas H. Kim-brough (who is married and has a family) and Jesse F. Kimbrough (who is at this time a minor) all my real estate of which I may die seized and possessed in Harris County, all of my stock of horses, mules, cattle, hogs and every other species of stock I may have at my death, together with my farm-ing interests, wagons, carts and such like and all my household and kitchen furniture of every description, money, (goods ?) [indistinguishable] in [indistinguishable]. I also give to them to be equally divided between them, except that my son Jesse F. is to have the advantage in the above named property in amount sufficient to purchase a good gold watch to make him equal with his brother Thomas H. who has already received one from me and except certain specific legacies to be paid my two above named sons, to my three grand children which amounts will be specifically named in item third, with the names of my three grand children. Item Third It is my will and desire that my two sons Thomas H. and Jesse F. Kimbrough pay to my three grand children to wit: Mollie, Lucy Clifford & Virginia S. Clark children of my deceased daughter Virginia Clark, two hundred dollars each at the time they (severally ?) arrive at age or marry the same to be paid out of the (effects ?) I have given my said two sons provided they have not the money in hand to pay them. Item 4th It is my will and desire that if my youngest son Jesse F. should die before he arrives at age or marries, that all the property that I have bequeathed to him go to his brother Thomas H. Kimbrough. Fifthly I hereby constitute and appoint my two sons Thomas H. & Jesse F. Kimbrough executors to this my last will and testament. This January 31st 1870. [s/] Frances A. Hines as her last will and testament in presence of us the undersigned who subscribe our names hereto in the presence of said Testator at her special instance and request and in the presence of each other. Stamford one of the subscribing witnesses to the within paper writing purporting to be the last will and testament of Frances A. Hines late of said county deceased, who after being sworn deposeth and says that he saw the said Francis A. Hines sign seal and declare the within writing to be her last will and testament (free ?) voluntarily of her own accord without any compulsion or undue influence whatever and that at the time of signing (same ?) the said testator was of sound disposing mind and memory. Deponent further saith that he saw the other witnesses sign the same in the presence of and at the request of the said Francis A. Hines. L. L.
