Recorded State of Georgia Harris County I, Gabriel Moss, of the aforesaid County and State being of sound and disposing mind and memory and being disposed to settle my worldly affairs do make this my last Will and Testament. 1st Item: I hereby require that all my just debts be paid by my executor herewithin named. 2nd Item: I give and bequeath all the rest of my estate to my father Henry E. Moss and 3rd Item: I do hereby constitute and appoint my father Henry E. Moss as executor to this my last will and Testament with full power to carry out this will in any way that he may deem proper without any order from the court. In witness thereof I have hereunto set my hand and seal this July 20th 1861. Gabriel Moss Signed, sealed, published and declared by the above named Gabriel Moss as his last Will and Testament in presence of us who at his request in the presence of each other have subscribed our names as witnesses thereto This July 20th 1861 John W. Moss senior named and appointed in a paper writing purporting to be the last Will and Testament of Gabriel Moss late of Harris county, deceased, as Executor of said deceased and produced such paper writing. And also, personally came John W. Sheperd and William O. Moss two of the subscribing witnesses to said paper writing who being duly sworn depose and say that they saw the said Gabriel Moss sign, seal, publish and declare the said paper writing now produced in open court as his last Will and Testament, freely, voluntarily of his own accord without any compulsion or undue influence whatsoever, - that at the time of the execution of said Will said Testator was of sound disposing mind and memory, - that deponents signed said will as witnesses in the presence of the testator and at his request in the presence of each other and that they saw Frances B. Moss the other subscribing witness sign said will the presence of the Testator and at his request. Sworn to & subscribed Before me in open Court - January 13 -1862- Geo. W. Mullins Ordinary John W. Moss Sr. named and appointed in the Last Will and Testament of Gabriel Moss late of said county deceased as the Executor to said Will and Testament having come into open court and produced said last will and testament for Probate and John W. Sheperd and William O. Moss two other subscribing witnesses to said will having ???? and subscribed the foregoing affidavit, in open court, in reference to his Testamentary capacity, It is therefore ordered by the court that said last Will and Testament be admitted to record in common force of law and that letters testamentary issue with him the said Henry E. Moss (Sr.) the Executor named and appointed in said last will and Testament, and that said Henry E. Moss having taken the oath prescribed and being duly qualified he is hereby appointed Executor of said Gabriel Moss deceased. It is further ordered by the court that William O. Moss, Henry E. Moss, Jr., James M. Culpepper, Daniel H. Zackry and John I. Evans be and they are hereby appointed appraisers to appraise said estate.
