J. F. Williams, Ordinary The petition of James W. Sparks shows that Wilkerson Sparks late of said County departed this life on the 28th day of July 1897, after having made his last will and testament wherein your petitioner is nominated the Executor, your petitioner produces said will in Court and prays that the same may be admitted to record upon the proof thereof in common form and that letters testamentary issue to him in terms of the law this August 2nd , 1897 Jas. M. Mobley J. W. Sparks Pets Atty Will of Wilkerson Sparks Georgia, Harris County I Wilkerson Sparks of said State and County, being of sound mind and memory, do make this my last will and testament. Item 1st I desire all my just debts be paid including a note held by James W. Sparks. Item 2nd I will and give and bequeath to Mrs. Kate L. Sparks, wife of my nephew James W. Sparks, Five Hundred Dollars. Item 3rd I give and bequeath , devise to the Trustees of the M. E. Church South at Bethel in said County, a certain tract, parcel of land in said County, known as the Wilkerson Sparks Bethel Church lands containing Forty-eight acres more or less, the same to be rented annually and the rents to go to pay the preacher’s quarterage land repairs of the church building ?? Item 4th I give, bequeath and divese to James W. Sparks One hundred acres of land off the lot no 1 in 22nd district of said County, known as the Blount lot containing 100 acres more or less. Item 5th I give and bequeath to Lane F. Sampson the East half of lot no 36 in the 22nd district of said County containing 100 acres more or less. Item 6th I give and bequeath to James W. Sparks Twenty acres off of the west side of lot 250 in the 22nd district of said County known as the Jim Jarrett place and I bequeath and give to Robt. S. Sparks One Hundred acres more or less of the same lot known as a part of the Jim Jarrett place. Item 7th I give to Louise Sampson daughter of R. N. Sampson, my piano. Item 8th I give to J. Wilkerson Sparks son of Jas. W. and Mrs. Katie B. Sparks, my watch which has been --------- to his mother for him many years ago. Item 9th I will give and bequeath all my entire estate not before herein disposed of consisting of lands, horses, mules, hogs, cattle, money, notes, accounts, and every other kinds of property or rights to the children of T. W. Sparks and I hereby authorize and empower my said Executor herein named to sell and or all of the said property on such terms ------ at such times and place as he may think proper, either with or without advertising and without any order of Court, and after paying all expenses the net proceeds of the same is to be equally divided among all the children of T.W. Sparks, share and share alike. The said property being the residual of my estate not previously disposed of. Item 10th I hereby constitute and appoint my nephew James W. Sparks Executor to this my last will and testament and expressly direct him that he shall not in any event by an court or any authority be required to give any bonds or security for the of his trust. This June 1st 1897. Wilkerson Sparks Signed, declared and published by Wilkerson Sparks as his last will and testament in the presence of the subscribers who subscribe our names hereto in the presence of said testator (at his insistence and request and of such other, he signing in our presence and we signing in his presence this 1st day of June 1897. Grant who on oath says that they saw the within named Wilkerson Sparks sign and publish the within paper as his last will and testament that they subscribed the same as as witnesses at the special instance and request of said Wilkerson Sparks and in his presence that the said Wilkerson Sparks signed the same freely and volunteerily and was at the time of such signing of sound and disposing mind and memory. Williams Ordinary Georgia Harris County I do solemnly swear that this writing contains the true last will of the within named Wilkerson Sparks deceased so far as I know or believe and that I will well and truly execute the same in accordance with the laws of this State. So help me God J. W. Sparks Sworn and subscribed before me Aug 3rd, 1897 J. F. Williams Ordinary Court of the Ordinary Harris County August Term 1897 Upon the foregoing affidavit of J. C. Grant, W. D. Moraw and J. D. Grant, the subscribing witnesses of the within will of Wilkerson Sparks deceased it is ordered by the Court that said will be admitted to records as satisfactorily proven in common form and it is further ordered that letters testamentary issue to James W.
