First I will and desire that all my just debts be paid by my executor herein to be appointed as soon as convenient without delay. Second I give and bequeath my beloved wife Caroline Roberts all my estate both real and personal during her natural life said estate consisting of three hundred and ninety five acres {--- fifty acres of the east portion of lot of land NO 25 of the said being the dower of Mrs. Charles Campbell dec’d.) lying and being in the 21st district of Harris County, and known as my homestead at this time, together with all my stock of Horses, Mules, Cows, Hogs, plantation and farming implements, Household and Kitchen furniture and every other species of property that I may have at the time of my death not already mentioned. Said property above named to be used for the benefit and mutual support of my said Wife during her natural life and for the support and maintenance and education of my two youngest children by my said wife Caroline to wit: Francis Ellen Elizabeth Roberts and John Thomas Roberts. Third At the death of my said wife Caroline, it is my will and desire that the above named property both real and personal named in the Second Item go to and be equally divided between my two children Frances Ellen Elizabeth Roberts and John Thomas Roberts and if either should die before my said wife then the survivor of my two above named children to inherit to have and to hold the whole amount of my estate so willed above to my said wife and two children in Item the Second of this my will. Fourth Having given my older children by my first wife to wit: Albert P. Roberts, Oliver E. Roberts, Miriam A. Scott, formerly Roberts, Martha J. Borders, formerly Roberts, Louisa A. Whitehead, formerly Roberts, Milton B. Roberts more than I am able to give those mentioned as legatees under my will is the reason why I have not made my older children above named by my first wife beneficiaries and legatees under this my last will and testament. Fifth I do hereby constitute and appoint my beloved wife Caroline Roberts and my son Milton B. Roberts Executrix and Executor of this my said last Will and Testament. Williams Ord’y Georgia } Harris County } Court of the Ordinary Feby Term 1876 Personally appeared in open court M. B. Roberts one of the executors named and appointed in a paper writing purporting to be the last Will and Testament of Jesse Roberts late of said County dec’d and produced said proper writing for Probate and also appeared in open court N., H. Barden and L. T. Purcell two of the subscribing witnesses to said paper writing who being duly sworn deposeth and saith that they saw the said Jesse Roberts sign, seal and publish and declare the said paper writing now presented for Probate as his will and testament freely, voluntarily of his own accord without any compulsion or undue influence whatever and at the time of signing said Testator was of sound and disposing mind and memory. That deponents signed said will as witnesses in the presence of the testator at his request and in the presence of each other and that they said Chas.
