WHATLEY DECEASED State of Georgia County of Harris I Seaborn J. Whatley of said State and county make this my last Will and Testament. I have paid to my three children to wit: Elizabeth Young, William H. Whatley and Sarah J. Partridge Thirty Six hundred dollars each in money and property. Now what I intend and direct is that my Son James L. Whatley and my two Daughters Catherine S. Clark and Laura C. Jones be made equal with the three first named children and by reference to the receipt of each one which is my possession if can be ascertained how much each have received and I direct my executor hereinafter named to pay to each one of my three last named children to wit: James L. Whatley, Catherine S. Clark and Laura C. Jones the amount sufficient to make them equal with the said Elizabeth Young, William H. Whatley and Sarah J. Partridge, if I should be possessed of that amount and if not then what I have to be equally devided between my three children Catherine S. Clark, Laura C. Jones and James L. Whatley, and in the event my estate should be [...] over that amount the surplus after all are made equal to be devided with all sharing alike in said surplus. Item Second, I hereby appoint my son James L. Whatley my Executor to execute this my last will and Testament. Seaborn J. Whatley We the undersigned signed this the last will and testament of Seaborn J. Copeland HARRIS COUNTY COURT OF ORDINARY MINUTES February Term 1887, p. 245 Whereas J. L. Whatley Executor of Seaborn J. Whatley, deceased having made application for leave to sell the land belonging to the Estate of said deceased and due and legal notice of said application having been once a week for four weeks in the HAMILTON JOURNAL a public gazette in this State and no objection being made, and it appearing that said land, one wild and uncultivated land, lying in the county of Upson, a county other than that of the administration. It is therefore ordered by the Court that J. L. Whatley Executor as aforesaid be and he is hereby authorized to sell at public or private Sale the following discribed land belonging to the Estate of said S. J. Whatley deceased to wit. One fraction lot Number (271) Containing fifty acres more or less in the 15th District of Upson County, Georgia, also one lot of land Number (260) two hundred & Sixty in the 15th District of Upson County kGeorgia.
