Hines Deceased recorded State of Georgia} Harris County } In the name of God Amen. I Elias D. Hines of said State & County knowing the uncertainty deem it proper both as respects my family and myself that I should make a distribution of the property with which a kind Providence has blessed me. I do therefore make this my last will and testament hereby revoking all others heretofore made by me. Item 1st I desire and direct that my body be buried decent and Christian like manner suitable to my condition in life my soul I trust shall return to rest with God who gave it. Item 2nd I desire and direct that all my just debts be paid without dely by any executor hereinafter appointed as I am unwilling my creditors should be delayed in their rights. Item 3rd I will and bequeath unto my daughter Elizabeth Tucker formerly Elizabeth Hines 5 dollars no more nor less. Item 4th I will and bequeath unto my daughter Sarah Hines one cow and calf, one bed and stead and clothing for the bed and five dollars in money no more or less. Item 5th I will and bequeath the residue of my estate both real & personal here and every where to my tow sons Elias D. Hines and Edward McDougle Hines to be divided as hereinafter provided. I will and bequeath one negro boy Andrew and one thousand dollars to Elias D. Hines my will and desire is that that my estate both real & personal be sold to the highest bidder in the town of Hamilton Harris County Georgia being duly advertised in terms o flaw provided my ------to be hereinafter appointed should think it for the best and be equally divided between my two sons Elias D. Hines and Edward McDougle Hines with the exception of the negro boy Andrew and one thousand dollars before mentioned. My will is for my son Elias D. Hines to have that much the advantage; and I will and design is that if either of my sons Elias D. Hines & Edward McDougle Hines should depart this life before arriving to the age of twenty-one years of age, the property thus willed inherited by the other. Item 6th I constitute & appoint my worthy friends James Smith and Henry E. Moss Executors of this my last will and Testament this January the 19th 1856. Elias D. Hines as his last will and testament in the presence of us the subscribers who subscribed our names hereunto in the presence of said testator at his special instance and request of each other.
