I, Benson Moss being of perfect mind and memory and knowing all men have to die and after death the Judgment – I first Recommend my soul to God, who gave it, and my body to be buried in decent Christian burial – Being called in the service of my country I feel it my duty to make some disposition of my property. First, Of all I will that my just debts be paid if any: then, I will that my loving wife hold all of my estate Real and Personal and that she, Clary Moss, hold and enjoy it with my five children in their raising during her natural life or widowhood and at the exspiration of her widowhood or in case of her death then all my estate to be sold and equally be divided with my aforesaid children – And I appoint my friend Burton T. Brown my Executor. In witness of the same I assign this my last and only will and testament. Benson Moss (his mark) In presence – Test – Hiram Brown E. R. White O. M. Duncan Probate – Hart Court of Ordinary Nov. Term 1864 Personally cmae into open Court Hiram Brown and O. M. Duncan who being duly sworn say that they saw Benson Moss sign the foregoing will that at the time of signing of the same the said Benson published and declared is to be his last will and testament. That deponents together with E. R. White whose name is thereto subscribed as a witness a witness signed the same as witness in the presence and at the request of the said testator at the date thereof. That Testator at the time of signing the same was in opinion of deponents of sound and disposing mind. O. M. Duncan Sworn to and subscribed in open Court This 7th day Nov. 1864 F. B. Hodges Ordinary (Oath of Executor-) I do solemnly the true last will of the within named B. Moss deceased so far as I know or believe and that I will well and truly execute the same in accordance with the laws of this state so help me God. B. T. Brown Nov. 7th 1864 F. B.
