S. Roberts Will State of Georgia Hart County I Francis S. Roberts of said State and county being of sound and disposing mind and memory do make this my last will and testament. Item 1st I will that my body be buried in a decent manner suitable to my condition in life. Item 2nd I will and direct that all my just debts be paid without delay. Item 3rd I give bequeath and divise to my present wife Sarah A. Roberts about Seventy five acres of land around the dwelling house wherein I now live with all the improvements thereon and in addition to one bed and bedding she now owns one other bed and bedding and one cow and calf said land to be run off by the county surveyor or some other competent surveyor and all the willed in this item be for the sole use and benefit of my said wife during her life or widowhood and at her death or marriage to revert to my estate and be sold by my executor and the proceed be equally divided among my children mentioned in Item fourth, and in case of the death of any of my said children leaving a surviving child or children such surviving child or children to receive the share of their parent. Item 4th I will and devise that the residue of my estate both real and personal at my death be sold by my executor and the proceeds be equally divided between my following named children to wit Mary E. Tiller, Charlott – Louisa E. Chandler, Fannie B. Lewis, Page 479 Georgia A. Bell, and Harriet A. Roberts – and that each account for what I have already advanced them said advancement being represented by notes and accounts held against them and in case either of said children should die leaving a surviving child or children to receive the share of their parent. Item 5th I have already given my son Thomas H. Roberts his full distribution share of my estate. Item 6th I hereby appoint my friend P. C. Cash Trustee of my daughter Harriet A. Roberts to act for her and manage her distribution share with such compensation as the ordinary may allow said Trustee to give bond and security to the ordinary of said county for the faithful performance of his duty with authority use the incom of distributive share of said Harriett A. for her maintainance and support and if necessary under the approval of the ordinary to use a sufficiency of the cap (?) from time to time for the purpose maintainance and support of said Harriet A. I further will that said Harriett A. have as much household furniture as the other children have had advanced to them and in the event said Harriet A. should die without leaving a child or children then her distribution share of my estate herein before specified shall revert to her brother and sisters. Item 7th I hereby appoint my son Thomas H. Roberts the executor of this my last will and testament with power to Page 480 sell the property herein before mentioned either at public or private sale in his discretion keeping in view the (?) intent of all the parties hereby revoking all other wills herein before made by me this June 5 – 1888. Roberts as his last will and testament in the presence of us, the subscribers, who subscribe our names hereto in the presence of said testator at his instance and request and in the and in the presence of each other he signing in our presence and we signing in his presence. Vickery saw the within papers as his last will and testament of F. S. Roberts sign and publish the within papers as his last will and testament that we subscribed as witnesses thereto at the special instance and request of the said F. S. Roberts and in his presents as did also N. J. Goss and J. E. Vickery that the said F. S. Roberts signed the same freely and voluntary and was at the time of such signing of sound and disposing mind and memory. Sworn & subscribed before me Sept 7 – 1891 A. R. McCurry F. C.
