Hester, wife of Allen Hester of Heard County, Georgia Georgia, Heard County To the Ordinary of said County The Petition of Armitta E. Hester, wife of Allen Hester of said County shows that her husband Allen Hester resides in said Heard County and that he is the head of a family consisting of himself, your Petitioner and two minor children to wit: Carrie Hester thirteen years old the 31st day of next July; Allen Hester nine years of age the 14th day of last January. That he refuses to apply for the benefit of homestead and exemption as provided under the Constitution of Georgia and the statutes in reference thereto and that in reference thereto and that Petitioner desires under the Constitution of Georgia and the statutes in reference thereto to have laid off and set apart as a homestead for the use of said family on and out of the property of her said husband Allen Hester to be exempt from levy and sale a homestead for the said family to wit: one plat of the real estate distinguished as lot number two hundred and seven (207) in the original eleventh district of originally Carroll but now said Heard County Georgia containing two hundred two and one half acres of land more or less and bounded on the north by lands of Nickolas Dyer, East by lands of Joseph P. Atkinson estate south by lands of W.H. Suttles, west by lands of Mrs. Jane Larrey the portion so set apart or the whole of said two hundred two and one half acres so set apart not to exceed in value one thousand dollars. Petitioner also desires to have exempted and set apart the personal property embraced in schedule "A" hereto attached to which reference is made as a part of this Petition. Said schedule contains an accurate description of all the personal property belonging to the said husband Allen Hester. Schedule "B" hereto attached contains a correct list of the names and post offices of the creditors of the said husband Allen Hester and said real and personal property all belongs to her said husband Allen Hester. Your Petitioner prays that an Order may issue to the county surveyor of said Heard County requiring her to lay off and make a plat of a homestead for said family out of and from said two hundred two and one half acres of land more or less and make return thereof in accordance with law. Ridley and Margaret Teal of the filing of this application for homestead and exemption and of the day of the hearing the same and that said notices were served by him on the sixth and seventh of this month respectively. Hester, wife of Allen Hester of said county having applied to me for the setting apart of a homestead you are hereby ordered to enter upon lot of land two hundred and seven in the eleventh district of originally Carroll but now Heard County GA and lay off a homestead for said Armitta E. Hester and her said husband and his family either in the whole or so much of said land as will not exceed in value the sum of one thousand dollars and make a plat thereof and return the same to me together with your estimate of the value of the land to be laid off, on or before the 23rd day of May 1904 under oath as prescribed by 2834 and 2837 sections of the code of Georgia. Ridley, County Surveyor of Heard County who upon oath says that in pursuance of an order directed to him by the Ordinary of said County he did on the 12th day of May 1904 enter on the lands described in said order and lay off a plat for mrs. Hester, wife of Allen Hester and the family of said Allen Hester, a homestead out of said Allen Hester's land of lot of land number two hundred and seven in the eleventh district of originally Carroll and now Heard County, Georgia containing one hundred and ninety eight acres of the value of nine hundred and fifty dollars a correct plat of which is described above and on the foregoing page.
