McSwain, filed in Heard County, Georgia in 1901: Widow's Indigent Pension of Mrs. S.C. McSwain, widow of Daniel McSwain State of Georgia, County of Heard Questions for Applicant S.C. McSwain of said state and county, desiring to avail herself of the pension allowed to indigent widows of Confederate soldiers, under Act of General Assembly passed in 1900, hereby submits her proofs and after being duly sworn true answers to make to the following questions, deposes and answers as follows: 1. What is your name and where do you reside? S.C. McSwain, Franklin, Heard County, Georgia. 2. How long and since when have you been a resident of this state? I have been in the state since my birth March 4, 1836. 3. When and where were you born? I was born in Columbus, Muscogee County, Georgia March 1836. 4. When and where was your husband born; state his full name and when were you and he married? My husband was born in Meriwether County, GA 1831 Feb 12. His name was Daniel McSwain. We were married Nov 1852. 5. When and where and in what company and regiment did your husband enlist or serve during the war between the states? He enlisted Oct 1, 1862 from Marion County in Company A 27th Regiment Georgia Volunteers. 6. How long did your husband serve in said Company and Regiment? He remained in that company and regiment to close of war in April 1865. 7. When and where did your husband's Company and Regiment surrender and was discharged? He was mustered out of service in Kingston, NC April 1865. 8. Was your husband present at the time and place when his Company and Regiment surrendered? He was there present with his company at that time. 9. If not with his command at surrender, state clearly and specifically where he was, when he left command and for what cause and by what authority? He was there with his Company. 10. When and where did your husband die? He died in 1885 in Heard County, Georgia. 11. Which of the following grounds do you have your application for pension, viz: age and poverty, infirmity and poverty or blindness and poverty? Infirmity and poverty. 12. State how long you have been in such condition that you cannot earn your support. My constitution and general health is wrecked and I am old and worn out. 13. What has been your occupation since your husband's death? I have done nothing but a little house work. 14. How much can you earn gross by your own exertion and labor? Nothing 15. What property, real or personal or income do you have or possess and it's gross value? I have no property, effects or income. 16. What property, real or person did you possess at death of husband or that he left you in the years 1899 and 1900 and what disposition if any, if by sale or gift, have you made of same. I have nothing more during these years than I have now. 17. In what counties did you reside in 1899 and 1900 and what property did you return for taxation? In Heard County and returned nothing for taxation. 18. How have you been supported since the death of your husband and especially for 1899 and 1900? By my son in law Jack Barnes (?? name difficult to read) . He has a large family and no property. 19. How much did your support cost for each of those years and how much did you contribute by your own labor or income? My support cost about $50. I contributed nothing. 20. What was your employment during 1899 and 1900? How much did you receive for each year? Nothing. I could do nothing and received no pay. 21. Have you a family? If so, who composes such family; give their means of support. Have they any lands or property? I have no family. 22. Have you ever made application for pension before? Yes. 23. How many applications have you made for a pension and under what class? 1 on death of husband from disease contracted in service. S. C. Kendrick of said State and County, having been presented as a witness in support of the application of Mrs. S.C. McSwain for pension and after having been duly sworn true answers to make to the following questions, deposes and answers as follows: 1. What is your name and where do you reside? In Marion. (W.R. Upton and H.H. Kendrick) 2. Are you acquainted with the applicant Mrs. S.C. McSwain; if so, how long have you known her? Yes, Since 1850. 3. Where does she reside and how long and since when has she been a resident of this state? Heard Co GA; all her life 4. When and where was she born: In Muscogee Co. 5. Were you acquainted with her husband: Yes 6. Where did he reside in 1861? Heard and Marion Counties. 7. When and to whom was he married? In 1852 to the applicant. 8. When and where was he born? In this State. 9. How long have you known him? Since 1862? 10. When and where did Daniel McSwain enlist in the war between the states and in what Company and Regiment did he enlist and how do you know this? In 1862 Co. A 27th GA. 11. Were you a member of the same company and regiment? I, Mr. Kendrick was. 12. How long did he perform regular military duty? About three years 13. When and where was his Company and Regiment surrendered and discharged from service? In April 1865. I think in South Carolina. 14. Were you with the command when it was surrendered? I was (Kendrick). 15. through 17 not answered, left blank. 18. When and where did the soldier die? In Heard County 1885, Upton's ??. 19. Where did he reside at his death and how long had he been a resident of Georgia at his death? In Heard County. All his life, at Upton's. 20. Do you of your own knowledge know that the applicant is a lawful widow of D. McSwain? Yes I do. 21. Has she remained unmarried since the death of her soldier husband and is she now a widow? She has. 22., 23, 24: What property, income or effects has the applicant and has she in 1899 and 1900? None 25. What is applicant's physical condition and her chances and ability to earn a support? She is too old and infirm, cant work at all. 26. Is applicant able to earn a support of labor of any sort? No 27. How was she supported in 1899 and 1900? By her son in law. 28. How much did applicant contribute to her support for the last two years: Nothing 29. Give a full and complete statement of the applicant's physical condition: Too old and infirm. U.R. Upton, H.H. Kendrick Witnesses March 13, 1901 Georgia, Heard County J.B. Davis of said state and County having been presented as a witness in support of the application of Mrs. S.C. McSwain for a pension and after being duly sworn according to law says on oath that he is personally acquainted with Mrs. S.C. McSwain; that she is aged and infirm and not able to make a living for herself by labor of any sort; that he has known her for fifteen years and she has never had any property, effects or income since he first knew her. That she is entirely dependent upon her son-in-law for a support as she cannot contribute anything toward it and he is not able to support her. That he has no interest in the recovery of a pension for her and is in no way related to her. J.B. Davis Sworn to and subscribed before me March 13, 1901. Robt G Crain, Ordinary Feb 7, 1901 Affadavit of Physicians State of Georgia, Heard County Personally came W.A. Ware and J.R. Daniel, both known to me to be reputable physicians of said county who being severally sworn say on oath that they ahve examined carefully Mrs. S.C. McSwain applicant for pension, and after such personal examination say that her physical condition is this: She is now suffering from general debility, constitution and general health is wrecked and she is old and worn out and not able to make a living for herself by labor of any sort. Daniel, M.D. Sworn to and subscribed before me this 7 day of February 1901 Robt G Crain, Ordinary of Heard County Jany 6, 1905 For Indigent Widows Heretofore Allowed Pensions State of Georgia, Heard County Personally comes Mrs. S.C. McSwain who being duly sworn on oath says that she is a bona fide resident of said County of Heard, State of Georgia, and that she has resided in said State continuously since birth in 1836, that she is the widow of Daniel McSwain who was a soldier in Co. A of the 27 Regiment of Georgia; that he died on the 24th day of January 1885; that she is all crippled up with Rheumatism, constitution and general health wrecked and she is worn out and not able to make a living for herself by labor of any sort and has no property. Deponent swears that she was the wife of said deceased soldier and that she has never married since his death aforesaid and that she became his wife in the year 1852. She has been allowed an Indigent Pension as a resident of Heard County for the year 1904 and now applies for the pension provided by law for the year ending December 31, 1905. S.C. McSwain January 12, 1907 For Indigent Widows Heretofore Allowed Pensions State of Georgia, Heard County Personally comes Mrs. S.C. McSwain who being duly sworn on oath deposes and says that she is a bona fide resident of said County of Heard, State of Georgia and that she has rsided in said State continuously ever since 24th March 1936; that she is the widow of Daniel McSwain who was a soldier in Company A of the 27th Regiment of GA Volunteers; that he died on the 24th day of Jan 1885; he contracted pneumonia during the war and died with said disease. She now applied for the pension provied for the year ending Dec 31, 1907. S.C.
