Brown Georgia, Heard County I, S.S. Brown of said state and county, being of sound and disposing mind and memory do make this my Last Will and Testament hereby revoking all wills heretofore made by me. Item 1st. I wish my executors as soon as possible after my death to pay my just and honest debts. Item 2. I give to my beloved wife, S.E. Brown as follows: one hundred and twenty five dollars in cash which I hereby direct my executor to expend in building tenant house with two sixteen ft. rooms and hall, chimneys to ?? and well upon the land I have this day deeded to her; one bay horse, mule named Scott, one young white cow and calf, sixty dollars in cash, with which I direct my executors to purchase for her a new buggy. I give to her the buggy harness I now have and also in addition to the above I give to her one hundred dollars to be turned over to her in cash, one cook stove and cooking utinsils, the same one we are now using and one set of cane bottom chairs. Item 3. Having already given to my son James H. Brown land to the value of seven hundred dollars and to my daughter Alice B. Owensby land to the value of five hundred dollars, I direct that Executors my invest the further sum of two hundred dollars on land to vest title to same for said Alice B. Owensby for her life with remainder over to the heirs of her body, share and share alike. Item 4. Not having heretofore made any advancement to my daughter Lila Lancaster, I hereby direct my Executor to expend seven hundred dollars in purchasing such tract of land as she may direct, the title to same to vest to her for her life and at her death to the heirs of her body, share and share alike. Item 5. Should the sums of money described in Item 3 and 4 herein be not fully expended in the purchase of lands as therein specified, but there should remain some small sum of the amounts thus appropriated, then I direct my executor to expend such sums on such improvements of said several tracts as he deem advisable. Item 6. I direct my executor at my death to sell all my real and personal property not heretofore disposed of and remaining at the time of my death said sale may be at private sale, should all the heirs consent thereto, but should they not all agree to said private sale of said property then said sale to be at public outcry. Item 7. After payment of my debts as provided in item 1, settlement of my burial expenses and providing a substantial and neat tomb for my grave and payment of legacies herein described, I desire that the remainder of my property be equally divided among my three children, to wit: J.H. Brown, Alice Owensby, and Lila Lancaster, share and share alike and that the sums be invested in the same manner and for the same uses as described herein in items 3, 4 and 5. Item 8. The reversionsary (?) interest in the 101 and 1/4 acres more or less this day deeded to my beloved wife for her lifetime and in lieu of homestead dower and years support right. I desire shall be equally divided among my three children aforesaid or their representatives should any of them be dead, share and share alike, respresentatives of my children taking "per stirpe" at terminiation of said life estates. Item 9. I hereby constitute and appoint my son James H. Brown the executor of this my Last Will and Testament upon his giving bond as required by law. J.H. Daniel Jacob L. Brown Thos. M. Awbrey ____ Codicil to Will of Silas S. Brown July 21, 1900 Georgia, Heard County I, S.S. Brown of said state and county being of sound and disposing mind and memory do make and add this Codicil to my Last Will and Testament signed and published by me in said county on July 11, 1900 in the presence and witnessed by J.H. Daniel, Jacob L. Brown and Thos. M. Awbrey. Item 1st. Referring to Item 2 of my said last will and testament above described, and in addition to the several items of bequest therein contained, I give and bequeath to my beloved wife S.E. Brown the sum of two hundred and fifteen dollars more than is in said item contained which said sum my executors are directed to pay over to her in cash as the other cash bequest in said item of my said will are paid over to her. Any residue of this bequest herein made which may remain at the death of my said wife if any, I desire equally divided among my three children named in my said will share and share alike. The various items of bequest contained in said item 2 of my said will, together with my the one hundred one and 1/4 acres of land more or less deeded my wife on the date of my said will with the additional two hundred and fifteen dollars I value the aggregate at about one thousand dollars which I desire to leave to my said wife and the conditions and restrictions placed upon each. Item 2. Referring to Item 9 of my said last will and testament, Since my son James H. Brown therein named as Executor is young, I hereby constitute and appoint my brother Jacob L. Brown also Executor to act with my son James and they are jointly constituted Executors to my last will and such codicil as may from time to time be added. Item 3. This Codicil in no way changes or affects any other item or part of my said last will and testament, said item 2 and item 9 thereof. In testimony whereof I have hereto set my hand this July 21, 1900. Brown as a Codicil and addition to the Last Will and Testament signed and published by me on July 11th 1900 as described above and as proof thereof in the presence of the undersigned who subscribed our names hereto as witnesses at the instance and request of said testator and in his presence and in the presence of each other this July 21, 1900. H.L. Harris J.J. Owensby Thos. M. Awbrey, J.P. --- Second Codicil to Last Will and Testament of Silas S. Brown August 10, 1900 Georgia, Heard County I, S.S. Brown of said state and county, being of sound and disposing mind and memory to make this second codicil to my last will made by me on July 11, 1900 and witnessed by J.H. Daniel, Jacob L. Brown and Thos. M. Awbrey. Item 1. Referring to Item 4 of the Will aforesaid in which provision was made for my daughter Lila Lancaster, the purpose of this codicil is to show that I have provided for her in a certain deed to land which I have bought from Spencer Darden, the value of said land is one thousand dollars. Now the further purpose of this instrument is that my said daughter Lila Lancaster shall only participate in the division of the residue of my estate as provided in Item 7 of my said will after my other two children have received a sufficiency of my estate to make them equal with her then said residue of my estate is to be equally divided among all of my said children as in the manner provided in my said will.
