Hubbard, R.C. Williams, R.B. Hubbard Last Will and Testament of Harriet Matilda Ashley, Deceased I, H. Matilda Ashley of said state and county, being of sound and disposing mind and memory, do make this my last Will and Testament, hereby revoking all Will heretofore made by me. Item 1. I will that my nephew J.B. Ashley have in money, Five Hundred Dollars and thirty six cents in cash that I have placed with him, free of interest during my natural life. Item 2. I will that after my death. J.B. Ashley, my nephew is to have Four Hundred and Fifty Dollars and thirty six cents in money. Item 3. I will that ny neice Mary Furlow is to have fifty dollars in money. Item 4. I will that Mrs. Mary Ashley and Miss Willie Ashley, wife and daughter of J.B. Ashley to have all of my beds, and bed clothing and wearing apparel of every description. In testimony whereof I have heretofore set my hand this 23rd of Dec 1908. Harriet Matilda Ashley X her mark Signed and published by Harriet Matilda Ashley as her last Will and Testament in the presence of the undersigned who subscribe our names hereto as witnesses at the instance and request of said testatrix and in her presence and in the presence of each other. Perdue, Ordinary Admitted to probate in Solemn Forum at the March Term 1909 Coweta Court of Ordinary as satisfactorily proven by all the witnesses. State of Georgia County of Coweta To the court of Ordinary of said county. The Petition of J.B. Ashley shows that on the 29th of December 1908 Hariet Matilda Ashley, late of said County, departed this life, after having made and published her last Will and Testament, in which no executor is named. Petitioner shows that the following named persons are the heirs at law of said deceased, to wit: Mrs. Ann Screws of Carroll County, GA P.O. Carrollton; Mary Furlow of Franklin, Georgia; Will Ashley of Franklin, Georgia; Phillip Ashley of Hightower, Alabama; Lilly Ashley of Hightower, Alabama; Reuben Ashley in State of Alabama; Lottie Bozeman of Graham, Alabama; Sallie Teal of Hightower, Alabama; Joe Ashley of Hightower, Alabama; Lizzie Norton of Lineville, Alabama; and J.B. Ashley of Newnan, Georgia. Said heirs reside as set out above... Petitioner produces said Will in Court and prays that it be proven in solemn form and to this he pray that the said Mrs. Ann Screws, Mrs. Mary Furlow, Will Ashley, Phillip Ashley, Lilly Ashley, Reuben Ashley, Lottie Bozeman, Sallie Teal, Joe Ashley, Lizzie Norton be cited to appear at the next term of the Court of Ordinary for said County to be held on the first Monday in March 1909 next, to show cause if any, why said Will should not be proven in solemn form and be entered of record as the Last Will and Testament of said deceased and that letters of testamentary issue to petitioner; that said parties reside out of the state of Georgia and can only be served by publication of notice of said proceeding by publication, that said notice be published once a week for four weeks in the Herald and Advertiser, a newspaper published in the city of Newnan, Coweta County, Georgia before the March term 1909 of said Court or Ordinary. To: Phillip Ashley, Lilley Ashley, Joe Ashley and Sallie Teal of Hightower, Alabama; Reuben Ashley of the State of Alabama Post Office Unknown; Lizzie Norton, Lineville, Alabama, Post Office Unknown; and Lottie Bozeman, Graham, Alabama and any and all other Heirs at Law of said Harriet Matilda Ashley residing out of the state of Georgia: Take Notice, that J.B. Ashley of the State of Georgia and County of Coweta has applied to the Court of Ordinary of said Coweta County for probate....and all parties concerned are hereby notified to show cause in said Court of Ordinary by the first Monday in March next why the said Will of said Harriet Matilda Ashley, deceased, should not be admitted to probate. State of Georgia, Coweta County Court of Ordinary of Said County The undersigned, who has been appointed administrator with the Will annexed of Harriet Matilda Ashley, deceased, comes now and tenders bond in the final sum required with H.C. Arnall, Jr. , T.G. Farmer as sureties and asks that the same be approved and filed and that petitioner have leave to qualify...Said bond is approved and ordered filed and recorded.
