Daniel Sr. of said County. Item 1st. I, J.H. Daniel Sr. being of sound and disposing mind and memory do make this my Last Will and Testament. Item 2nd. I wish my executor as soon as possible after my death to pay my debts. Item 3rd. To my son, J.W. Daniel, the house and lot I now occupy and known as my present residence containing two acres more or less and bounded on the North by street leading from the Saul place to the Franklin Bridge on the Chattahoochee River to the street leading from the Courthouse square in said County south via J.M. Buttrell's ?? place south by lot of Frank S. Loftin and west by lands of J.W. Daniel; This place is in the town of Franklin, I give and bequeath. Item 4th. I Will all the residue of my estate except that portion that I have this day made deeds to to my two daughters Josie Hendrick and Hellen Hendrick, of whatsoever kind it may consist whether real or personal property or money notes or accounts or anything else, to my said son J.W. Daniel. Item 5th. I bequeath nothing in this Will to the heirs of my son J.H. Daniel, dec'd for the reason I consider that during his lifetime I gave to him sufficient property, money and effects as would amount in value to one fourth of my estate. Item 6th. I bequeath nothing in this Will to either of my two daughters Josie Hendrick and Hellen Hendrick for the reason I heretofore given to each of them and their husbands A.G. Hendrick and Hugh L. Hendrick respectively sufficient property, money and effects that which I have this day conveyed to each of them by deed as would amount in value to one fourth of my estate, each one getting one fourth. Item 7th. I hereby appoint my son J.W. Daniel executor to this my last Will and Testament and relieve him from making any appraisement of my estate and from making annual returns to the Court of Ordinary and he is empowered and hereby authorized to compromise or settle any and all claims against my estate in such manner as he may think best without any order from said Court of Ordinary and for this purpose he is empowered to sell anyof my property real or personal at private or public sale as he thinks best without any order from the Court of Ordinary and to make deeds and ? to the same. In testimony whereof I have hereunto set my hand and seal this the first day of January 1898. J.H. Daniel Signed and published by J.H. Daniel Sr. as his Last Will and Testament in our presence and witnesses thereto by his request we signing as witnesses in his presence and he signing in our presence this January 1, 1898. H.A. Tompkins, L.L. Bevis, J.W. Cook, J.W.Powers Filed in Office 2 January 1899. Robt G. Crain, Ordinary Georgia, Heard County We, J.W. Cook, J.W. Powers do swear that we as well as H.A. Tompkins and L.L. Bevis saw the within named J.H. Daniel Sr. sign and publish the within paper as his Last Will and Testament that we subcribed the same as witnesses thereto at the special instance and rquest of the said J.H. Daniel Sr. and in his presence as did also H.A. Tompkins and L.L. Bevis, that the said J.H Daniel signed the same freely and voluntarily and was at the time of such signing of sound and disposing mind and memory. Sworn to and subscribed before me Jan'y 2, 1899. J.W. Powers, J.W. Cook. Georgia, Heard County I, J.W. Daniel, do solemnly swear that this writing contains the true Last Will of the within named J.H. Daniel Sr., deceased so far as I know or believe and that I will and truly execute the same in accordance with the laws of this State so help me God. J.W.
