Will of David George 02 Sep 1861 Henry County, GA HENRY COUNTY, GEORGE - 1860 LAST WILL AND TESTAMENT OF DAVID GEORGE Late of said County and the Codicil attached there to so far as they know or believe and that they will and truly execute the same by paying first the debts and then the legacies contained in said will and prodisile as far as his goods and chattels will there unto extend and the law change them that they will make a true and perfect invitary of said goods and chattels. David George, Snr, of said state Henry County | and County, being of advanced age, but of sound disposing | mind and memory, knowing that I must shortly depart this life, deem it right and proper, both as respects my family and myself, that I should make a disposition of the property with which a kind providence has blessed me, do therefore, make this my last will and testament, hereby revoking and annulling all others, by me hereto for made. FIRST, I desire and direct that my body be buried in a decent and christian-like manner, suitable to my circumstances and condition in life. My Soul and ___(?)__, shall return to rest with God who gave it, as I hope for salvation through the miracle and atonement of the blessed Lord and Savior Jesus Christ. SECONDLY - I desire and direct that all my just debts be paid without delay, by my executor hereinafter named and appointed. THIRDLY - I give and bequeath to my loving wife, Sarah, for and during her natural life only lots of land number two hundred twenty two (222) and one hundred and ninety five (195) in the Eleventh District of Henry County containing two hundred two and a half acres each, with all the rights, numbers (?) and appurtenances to said ___(?)___ lots of land in any __ (?)___ belonging. I also give and bequeath to my beloved wife the entire stock of provisions for man and beast, and the groceries as __(?)____, if any, that may be on hand at the time of my decease, I also give and bequeath to my beloved wife the farming utensils used on and belonging to the farm on said two lots of land. And three mules or horses, such as she may choose from my entire stock of mules and horses: my entire stock of cattle, sheep and hogs. And my household and kitchen furniture, all for and during her material life. FOURTHLY - I give and bequeath to my beloved wife, for and during her material life, my negro man Mitchell, about forty years of age, my negro Mintie about twenty four years of age and her four children, to wit, Prince, about eight years of age, Essa about six years of age, Ath about three years of age, and Reed about six months old. The property bequeathed in the above articles to my wife, is in full extinguishment of her whole right of Dower in my real estate. FIFTHLY - I desire and direct that the residue of my property both real and personal, after my deceasing shall be sold at the place wherein(?) I now reside, by my executors after named and appointed, and that the net proceeds of said sale of property shall be divided, after the payment of all just debts, among my several children in the manner herein after named. SIXTHLY - To my daughter Margaret Awtrey, wife of Eldrige Awtrey, for her sole and separate use for and during her natural life, free and exempt from the debts an liabilities of her present or a future husband, I give and bequeath one twelfth part of the money arising from the sale of property remaining after my bequest to my wife are satisfied, after the following deductions have been made from said twelfth part, namely, four hundred dollars for a piece of land heretofore given her. And ten ($10.00) dollars for a cow more given to her than the rest of my children. The property in this article contained at the death of Margaret Awtrey shall pass to and become the property of the children, and representatives of children, of said Margaret forever (I mean by the representatives of children, the children of children) SEVENTHLY - To my son, Joshua, I give and bequeath in like manner, one twelfth part of the net money arising from the sale of my property, heretofore divided to the said without any deductions or any restrictions. EIGHTHLY - To my daughter Martha Stanly, wife of John Stanly, in like manner, I give and bequeath a twelfth part of the net money arising from the sale of my property, heretofore directed to be sold, without any deductions or restrictions. NINETHLY - To my son Hansford D., in like manner, I give a twelfth part of the net money arising from the sale of my property, heretofore directed to be sold without any deductions or restrictions. TENTHLY.. To my David, I give in like manner, a twelfth part of the net money arising from the sale of my property, heretofore directed to be sold, with any deductions or restrictions. ELEVENTHLY, To my daughter, Mary Bartlett, wife of Robert E. Bartlett, I give and bequeath, in like manner, for and during her natural life, free and exempt from the debts and liabilities of her present or future (?) husband, a twelfth part of the net money arising from the sale of my property, heretofore directed to be sold, without any deductions and I hereby appoint my son Casey (Carey) W. George trustee of the money __(?)___ in this article to my daughter, Mary Bartlett. The money in this article contained (at the death of my daughter Mary Bartlett) shall pass to and become the property of the children, and the representatives of the children, of said Mary forever - (I mean by the representatives children, the children of children.) Twelthly To my son Jennings, in like manner, I give and bequeath a twelfth part of the net proceeds of the sale of my property heretofore directed to be sold, without and deductions or restrictions. Thirteenthly - To my daughter Louisa Johnson, wife of Pleasant P. Johnson, in like manner, I give and bequeath, a twelfth part of the net money arising from the sale of my property, heretofore directed to be sold, without any deductions or restrictions. Forteenthly - To my son Jesse N, in like manner, I give and bequeath a twelfth part of the net money arising from the sale of my property, heretofore directed to be sold, without any deductions or restrictions. Fifteenthly - To my son Casey W., in like manner, I give and bequeath a twelfth part of the net money arising from the sale of my property, heretofore directed to be sold, without any deductions or restrictions. Sixteenthly - To my son Andrew J., in like manner, I give and bequeath a twelfth part of the net money arising from the sale of my property, heretofore directed to be sold, without any deductions or restrictions. Seventeenthly, To my daughter, Sarah H. Clayton, wife of Francis M. Clayton, in like manner, I give and bequeath a twelfth part of the net money arising from the sale of my property, heretofore directed to be sold, without any deductions or restrictions. Eighteenthly, I hereby appoint my son David George trustee of the money devised to my daughter Margaret Awtrey, wife of Eldrige Awtrey in the sixth article of this will and of all other moneys hereafter devised to her in this will. Nineteenthly - After the death of my beloved wife, I desire and direct that the property given to her in the third and fourth articles of this will be sold by my Executors hereinafter named and appointed, and that the net proceeds be equally divided among the above named legatees: that the shares of Magaret Awtrey, wife of Eldrige Awtrey, and of Mary Bartlett, wife of Robert E. Bartlett, go to them with the same restrictions that the sums heretofore devised to them in the Sixth and Eleventh articles of this will, and that the same individuals by (?) trustees of said moneys, that have heretofore been appointed to the sums of money heretofore bequeathed to the said Margaret and Mary. Twentiethly - I surely constitute and appoint my sons Hansford D. and Jesse N. George Executors of this my last Will and Testament.
