Ellis of said state and county being of advanced age but of sound disposing mind and memory. In view of the fact that I have not long to live in this world do hereby for the purpose of making a just and proper disposition of the property with which a kind providence has blessed me make this my last will and testament revoking all former wills and devises. First - I commit my soul to God who gave it hoping to attain a home free from all cares & strife which are attended upon an earthly existance. Second - I desire to buried in the family cemetary in a decent and Christian like manner suitable to my circumstances in life. Third - I desire that all my just debts be paid as early as practible & all my affairs be properly and promptly wound up. Fourth - That my entire estate both real and personal be administered the administrator giving bond and qualifying in terms of law. Fifth - I desire that my entire estate be equally divided among my children to wit: W. A. Ellis, M. E. Maddox, Jas. T. Ellis, Lucy O. Holmes, C. Henley, J. J. Ellis, Robt E. Ellis, & L. M. Ellis, after the payment of the debts & expenses of administration, provided that I have advanced to several or all of said children different amounts and at different times which advancements I have made a memorandum of sand which amounts each must account for to the Administrator out of his distributive share, said memorandum to be found in my trunk unless I shall hereafter put the same in the hands of some suitable person to hold, for which I will take receipt & file. Sixth - As my son Jas. T. Ellis has pending against me a suit in the superior court of said co. which suit I consider unjust I desire that the same shall be dismissed by him or that the administrative charges up and come out of his distributive share the whole of the principal interest & costs of said suit.
