C, page 048 Georgia This indenture made the fifth day of November, in the Houston Co. year of our Lord one thousand eight hundred and twenty five, between James Dean of the County and State aforesaid, of the one part and Richard Smith of the County of Twiggs and State aforesaid of the other part, witnesseth that the said James Dean for and in consideration of the sum of sixteen hundred dollars to him in hand, well & truly paid by the said Richard Smith at or before the sealing or delivery of these presents the reciept whereof is hereby acknowledged hath granted bargained sold released and confirmed and by these presents grant bargained sell release and confirm unto the said Richard Smith, his heirs and assigns all that tract or parcel of land situate lying and being in the (10) tenth district in the county of Houston containing (405) four hundred and five acres more or less known and distinguished by lot numbers (12) twelve and (20) twenty one by the plan of said district, to have and to hold the said tracts or parcels of land unto him, the said Richard Smith, his heirs, and assigns to his own proper use benefit and behoof forever in fee simple together with all and singular rights numbers and appertanances thereof whatsoever to the said tracts or parcels of land being belonging or in anywise appertianing and the remainder revisions rents issues and proffits thereof and every part thereof to have and to hold the said tract of land and all and singular premises and appertainances thereunto -- belonging and every part thereof unto the said Richard Smith his heirs and assigns to the only proper use benefit and behoof of said Richard Smith, his heirs and assigns against himself, the said James Dean, and his heirs and all and every other person and persons whomsoever shall and will warrant and forever defend by these presents.
