Will of John Killen 11 Feb 1869 Houston County, GA State of Georgia, Houston County In the name of God Amen: I John Killen of said County and State aforesaid being of advanced age, but of sound and disposing mind and memory, and being desiring to settle my worldly affairs while I have strength to do so do make and publish this my last will and testament hereby revoking all wills by me at any time heretofore made. 1st I commit my soul to God who gave it and I desire my body to have Christian burial suitable to my circumstances and means 2nd I give and bequeath to my beloved wife Margaret in lieu of dower during her natural life, for her own use and benefit and for the other purposes hereinafter named the following property to wit, that portion of the land belonging to me of the place on which I now reside lying on the north side of the road from Perry to Henderson including the dwelling house and amounting to two hundred and seventy acres more or less all my household and kitchen furniture including the piano, my carriage and buggy two mules and three head of cows and calves to be selected by her from my stock of mules and cattle, as many of my stock hogs as she may need and select a sufficiency of plantation tools including one wagon and gear to enable her to keep up her farm for one year after my death and a comfortable support for one year for herself and my two daughters Sarah Feagin and Margaret Killen the provision for support of my said two daughters to be conditioned upon their remaining unmarried and continuing to reside with my wife. 3rd I desire my two daughters Sarah Feagin and Margaret Killen to remain with my wife and share and enjoy with her the benefits and profits of the property bequeathed to her in item 2nd so long as they or either of them shall continue unmarried and at the death of my wife the property bequeathed to her in said 2nd item of this will rest in them absolutely and be divided equally between them share and share alike 4th I desire that neither the payment of my debts nor of any legacies hereinafter made by me in this my will shall be charged upon the property bequeathed by me in items 2nd and 3rd 5th I give and bequeath to my son William F. Killen the plantation on which he now lives on and known as the "Chastain Place" I also give to him three more acres of land in front of his dwelling. It is also my wish and desire that my said son William F. pay to my daughters Sarah Feagin and Margaret Killen the sum of five hundred dollars each as they may need it out of the proceeds of said farm bequeathed to him. 6th I give and bequeath to my sons Thomas M. and George W. Killen my plantation on Flat Creek containing nine hundred acres more or less, also one hundred and fifty acres of land on the South side of the road from Perry to Henderson near my residence. It is further my wish and desire that the said Thomas M. and George W. pay to my sons Samuel D., John S., Theodore N., and James M. Killen the sum of five hundred dollars each, said amount to be paid as soon as practicable out of the profits of the property bequeathed to them If said sums can be paid before the expiration of two years after my death out of the aforesaid profits I desire them to be paid but if said property has been insufficient to pay the same in full, I desire any balances due thereon to bear interest and to be collected from the said Thomas M. and George W. Killen 7th I give and bequeath to my son Theodore N. Killen the gold watch which I wear 8th It is my wish and desire that at my death whatever ready money I my have that my Executors hereinafter named keep a sufficiency of said money to carry on my farm for the present year and the overplus I wish equally divided between my wife and three daughters Jane P. Tharpe, Sarah Feagin, and Margaret Killen share and share alike 9th It is my wish and desire that my Executors pay to my son Samuel D. Killen five hundred dollars extra of the five hundred bequeathed to him in the 6th item of this will said amount to be paid out of the net proceeds of the crop made this year, the balance of said proceeds after paying all expenses of the farm to be equally divided between my wife and daughters Jane P Tharpe, Sarah Feagin, and Margaret Killen share and share alike 10th I give and bequeath to my sons Thomas M. and George W. Killen all the mules, wagons, cattle, hogs, plantation tools on the Flat Creek plantation (with the exception of what may be claimed in item 2ndof this will) after the present crop is made and disposed of 11th I nominate and appoint my sons William F. and Thomas M.
