MOON-(A visit to the Williamson Cemetery-1838) By virtue of a commission from the honourable the Superior Court of Jackson Co. Georgia to us directed, We have caused John W. Moon the person in the said commission named to come before us and being duly sworn true answers to make to certain interogatory to the said Commission annexed, deposeth and answereth as follows~~~ To the first interogatory he answers, I am acquainted with John Williamson, now deceased, he was my Uncle & I his oldest nephew, also with Aunt Winny one of the parties in the above case, Wife of the deceased, as to James B. Nabers, I have only had a partial acquaintance. 2nd Interogatory-he answers, I had a conversation with John Williamson deceased sometime between the 15th & 20th of March 1838 in his own plantation at the Grave Yard whare his mother & my own mother ware Buried, and others of the connection. He stated that he received the most of his property from his Father, was left the Executor of his Father’s Estate, and as Executor he should run out his Father’s will; as it respected his own property, as left to him by his Father, he would divide it equally amongst all his children, he said, says he, Johnny the property has all come through your Grand Father’s hands. I think he has given your Cozen Nathan an Equivelent to what I can give the the rest of the children, but as Nathan has become crippled by falling in a well, he would give him an equal part, and his property should be divided amongst all his children equally. ______________________ Note: Line by line format followed. MOON-(A visit to the Williamson Cemetery-1838) 3rd Interogatory-he answers, I do not know of him being under the control of anny person, I know what he stated, he stated that he had not the power to do as he wished, says he, Johnny I see your Grandfather’s property melting away, your uncle billy(#1)has divided his property amongst the Connection, and he received his start from your Grand daddy, a great deal of it is going like chaff before the wind, as it respects My Self, I have no power over annything that I have, I allmost see starvation stare me in the face-then stated to me, that he had given a Hundred dollars for a Horse, and one of the boys had taken him against his positive command and had run him to death in a day, he stated that Mike was an excellant fellow to work, and to take care, but it almost made him mad to receive anny directions from him, while we ware standing at the grave yard, they ware, that istheHands ware sowing Oats, at night when Mike returned home he asked him why the Hands ware standing still in the field, Mike replied that their was no-time lost that he need regret, and it is none of your business while I have the controle of the hands. 4th Interogory-he answers, he stated to Me at the grave yard, here is your Grand Mother and your Mother, your uncle billy, and your brother, My son William, and others of the connection, all buried here, I want to see Boler, your uncle Adam, and Williamson McClusky, and let us have this walled in, in my life time, he then stated that he had spoken to McClusky respecting it, McClusky said that he had paid Durham for walling in Your Uncle ______________________ (#1) William Williamson died in 1834. He willed his property to many nieces and nephews! _______________________________________________________ (Page 3) DEPOSITION OF JOHN W. MOON-(A visit to the Williamson Cemetery-1838) Willy’s Grave, he then stated that the money he paid was a note that your uncle billy held upon Anderson Durham, he then stated that he wished that dun, that is the grave walled in with a stone wall, and while in his proper mind, he intended to make a will, and divide his propertyequallyamongstallhis children, so that their should be no fussing amongst his children, like their was about your grand daddy’s property. Further, I know not~~~ Cross Interogatorys 1st Cross Interogatory-he answers-I have not~~ I have been to his house in March 13th 1832 I have been their within 15 years~ 2nd Int. I was their and wanted to borrow money in 1838, and was refused, saying, Johnny you have come to a bad place, I have just had to pay a large note in the bank for which I was security, and it has dreaned me of money, he stated that your Aunt Winny & Mike had money, but she would not let him have it to loan me~~ (Note: Evidence of security note debt found in Court records!) 3rd Int. he answers, We ware not, and as to my own Family, they ware not~~ ______________ Answered, Subscribed and Sworn to before us this 18th day of Aug 1850 John W Moon Com {Richd S. Schwenele(?) [LS] {Wm. Nabers [LS] _________________________ Note: The only evidence of "walling" at the family cemetery is as described in my summary, "WILLAMSON KIN". Two brick mounds are marked as the graves of John (Jr.)& wife, Winney. I believe this metal plaque is placed in error, and should have indicated the graves nearer son, Micajah Williamson(twin, machined stones- totally obscured)! _____________________________________________ Larry C. Conyers, Georgia 30094-6162 Atlanta local: 770-483-3126 Additional Comments: This deposition was one of many taken regarding the estate of John Williamson Jr. of Jackson Co. John Jr. died on October 25, 1849. A will was presented and quickly contested. The case pitted widow Winney Williamson, bachelor son Macjah William(and younger children)against the older children(Jas. B Nabors et al). The will was set aside in Jackson County Superior Court in August 1853. The decision was upheld in the Georgia Supreme Court-October Term, 1853. Legal wranglings(including a Court of Equity)continued for seven or eight more years! This particular desposition was taken in Oglethorpe Co. and describes an 1838 visit to the Williamson family cemetery in Jackson Co. As stated, John W. Moon was the oldest nephew of John Williamson Jr. He was the son of Bolar and Sarah (Williamson)Moon. "John" is believed to be the Jackson W.
