Smith, Jacob M.Smith, Elizabeth Smith, William Smith, Mary S. Smith, Sarah Smith, Malisia Smith who are my grand children and children of William W. Smith and Margaret F. Smith and all other children that may hereafter be borned by the same Margaret F. Smith to her present or any future husband of the other part. Witnesseth that I the said Jacob Brooks does for and in consideration of the sum of five dollars in hand paid the receipt whereof is hereby acknowledged and for and in consideration of the natural love and affection which I have and bare to may said grandchildren hath given grants and conveys unto ths said JWS, JMS, ES. WS, MJS, SAS and MS who are children of Margaret Smith and all other children that may hereafter be borned by the same MFS either by here present or any future husband and to their heirs and offspring a colored Negro woman named REA? eighteen years and her child one year old named Fredrick to have and to hold same negro woman and said Fredrick with all their future increase to them the siad JWS, JMS, ES,WS,MJS,SAS,MS,who are children of my duaghter Margaret F. Smith with all others hereafter and children by the same MFS either by her present, or any future husband to ? ? heirs and assigns to be equally devided between my same grandchildren share and share alike which said divisions shall take place after the death of my said daughter, MFS, or as soon thereafter as convenient may allow. In testemony thereof I have set my hand and seal this 11th day of October 1860. Jacob Brooks Additional Comments: William W. Smith and Margaret Frances Brooks Smith left Jackson County after 1867 and were found in Prentiss County, MS on 1870 census record.
