Gathright, 1858 Last will and testament ==================================================================== Transcribed and submitted by Dawn Watson (booleygirl@aol.com) Will Book A, Jackson Co., GA, pp. 422-4 To all persons & authorities to whom these presents may come, know ye that I, William M. Gathright, of Jackson County Georgia being now in my perfect sence & of sound disposing mind & memory & knowing the [uncertainty?] of Life [have?] thought proper to make my Will & Dispose of the property it has pleased God to Endow me with which I give, demise & dispose of in manner & form following (viz) Item 1st I give & bequeath to my daughter Sinda Haynie the whole she stands charged with in a Book of accounts which I keep against my children amounting to four hundred & fifty dollars in money & a bed & furniture at forty dollars to her & her Heirs & assigns forever Item 2nd I give & bequeath to my daughter Orra Morgan the whole she stands charged with in said book of accounts amounting to four hundred & fifty dollars in money & a bed & furniture at forty dollars to her Heirs & assigns forever Item 3rd I give & bequeath to my daughter Milly Pittman the whole she stands charged with in said Book of accounts amounting to four hundred & fifty dollars & I direct my Executors to pay to her fifty dollars more than the rest of my daughters as she staid longer with us & consequntly done more for us than any of the rest of my daughters to her & her heirs & assigns forever Item 4th I give & bequeath to my daughter Sally Pittman the whole she stands charged with in said Book of accounts amounting to four hundred & fifty dollars in money & a bed & furniture at forty dollars & woman's saddle & I give her also three hundred dollars. I give her in [illegible] of my negro woman Violet which is to be deducted out of her proportionate part of my Estate to her & her heirs & assigns forever Item 5th I give & bequeath to my daughter Caroline Potts the whole she stands charged with in said Book of accounts amounting to four hundred & fifty dollars in money & a bed & furniture at forty dollars & a woman's saddle to her & her heirs & assigns forever Item 6th I give & bequeath my Zebulon the whole he stands charged with [in] said Book of accounts amounting to three hundred & eight dollars & give him the further sum of one hundred & ninety two dollars which is the first distribution share thereafter. I also give him my Low County Land (viz) one Lot of Land Drawn & granted to James Nash & also another Lot of Land granted & Drawn by Thomas D. Berry to him & his heirs & assigns forever Item 7th I give & bequeath to my son John C. Gathright the following tract or parcel of Land (viz) beginning at a Dogwood corner near the Potts field on the River thence runing on the original Line of the Johnson Tract of Land to where it crosses the Jones Branch the second time thence up the Branch to the head thereof from thence a Direct Line to a honey [illegible] in old field from thence a Direct Line to gum corner on the Reedy Branch the Gum corner being one of the original corners of the [Baumbals?] Tract of Land thence Down the Reedy Branch to the Creek thence Down the Creek to a persimeon corner of Land I Bought of Collins thence on the Collins Line to Chesnut corner on the Mrs. Glass Line thence on the Mrs. Glass Line to a stake corner joining Haynie & Jackson thence along the original line forming Jackson to a white oak corner near the James [Janys?] old spring this Line Runing through the Middle of sd. spring thence along the original Line to a Sugar Tree corner on the bank of the River thence up the River to the Begining Dogwood corner & further him my Smooth Bore Rifle Shot gun to him & his heirs & assigns forever Item 8th I give & bequeath to my son William M. Gathright all the Bottom of my Land Lying here in this Body imbracing my Dwelling house and plantation & not willed to my son John C. Gathright subject nevertheless to the full & free possession of the same by my wife Milly during her Lifetime & further give him all my plantation Tools & [utentials?] & my Rifle Gun to him & his heirs & assigns forever Item 9th I give & bequeath to my wife Milly the whole of my Stock of Cattle Hoggs & sheep or so much thereof that I am in Right [*****] of they being now in the care & possession of my son William. I also give her all my house hold & Kitchen furniture of Every kind & description whatever & for her to Dispose of the Same in any way or manner she may think proper. I also give her the use of my Mare & Buggey but at her Death my Executors will sell the Mare & Buggey Item 10th I Direct my Executors to collect from my two sons John C. Gathright & William M. Gathright the sum of one hundred dollars a peace & I now charge them one hundred dollars each of them to be paid to my Executors in Instalments of three years if they Require such Indulgence & as these will be considerable money after paying of the Legacis as Directed in my Will, it is my Will that it should be Equally Divided amongst all my children Except my sons John C. Gathright & William M. Gathright who is not to Receve any more of my Estate. It is my Will that all my Books be Lotted in three Lots according to value & to be Drawn for by my three sons John C. & William M. & Zebulon P. Gathright & it is my Will that Zebulon should have my Shot Gun. I hereby nominate & appoint my two son in laws Wilkins Haynie & A. B.
