Nabers et al Applt * Georgia Jackson County I John Williamson of said State and County* being afflicted and weak in body but of sound* mind and disposing memory do ordain this my last will & testament as* follows: I bequeath my soul to God who gave it and my body to my* Mother dust to be buried at the discretion of my surviving friends and as* to my worldly estate wherewith it hath pleased God to bless me, it* is my will that it be disposed of in the following manner. It is my* will that all my just debts be paid out of my estate and that all* my estate both real and personal, rights and credits, be left at the* discretion of my wife Winney Williamson during her natural life.* And whereas I consider that my children, Nathan C. Williamson, John* L. Williamson, Nancy King, Sarah Aderhold, Eliza Nabers,* Levicia Lowry, Mary Appleby, and Andrew J. Williamson, hath* already had an equal portion of my estate so far as I was possessed* of at the time they received it, and have had the use of it since, I desire* that my two sons, Jasper M. Williamson and Cranston B. Williamson,* have each three hundred dollars to make their portion equal with* the rest, and after the death of my wife Winney Williamson, it is my will* that all my estate that is left in her care shall be equally divided* between my children Macajah Williamson, Adam A. Williamson,* Lafayette Williamson, James C. Williamson, Winney Ann Williamson,* and George W. Williamson, or any of them who may be living at* the time, or their offsprings if they should have any, to be thrown* into lots and drawn for by the above named children and I* hereby appoint my wife Winney Williamson my Executrix during* her life, and my sons Micajah Williamson and Adam A. Williamson* my Executors after her death, to see that the whole of this my last will and* testament be executed, and I hereby revoke and annul all(Interlined* in the 23rd line before signed)other wills and testaments heretofore* made by me. Additional Comments: The above transcription is a reasonable facsimile of the will found on page 592, Book 1849(?). Subsequent pages, through page 599, offer some of the legal proceedings(including an inventory of the estate-January 23, 1850)prior to the final verdict in Jackson County Superior Court, August 29, 1853. The will was overturned by the listed jury. An appeal was made to the Georgia Supreme Court, where in the October Term 1853, the lower court decision was upheld. The widow, Winney Williamson, son Macajah Williamson, and Hoscea C. Giddens were later appointed administrators and the case returned to Jackson County, to a Court of Equity. It was ultimately given to a panel of arbiters, and final distributions were not made until late 1857, and early 1858.
