Petition of Elizabeth Kitchens to probate a copy of her husband's will * Indicates end of line in original document. The petition of Elizabeth Kitchens widow showth* that her husband Charles Kitchens of said County* departed this life on the 13th day of January 1864 in* said County. That the heirs at law of the said Charles* Kitchens dec. consisted of your petitioner, Joel Kitch* ens, Barthenia Willson widow, Sallie Sansome widow* all of said county, Moses Kitchens of Newton County* Matilda Dearing widow and the orphan children* of Nelson Kitchens of Butts County, William B.* Kitchens of Jasper County, and Henry Kitchens of* Jasper County. That said Charles Kitchens died tes(?)* tated(?) leaving his last will and testament and* that since the death of the said Charles Kitchens* his said last will and testament has been lost or* wrongfully destroyed to prevent the execution of the* same. That letters of administration were on the* first Monday in April 1864 granted by the Ordinary* of Jasper County to Jessie M. Owens of Newton* which atty for petitioner prays may be revoked* That under the provisions of said last will and tes* tament, a true copy of which is here in Court* produced and propounded for probate in solemn* form by your petitioner as sole legatee-and* devisee and your petitioner prays that citation* and notice do issue to the said heirs at law of the* said Charles Kitchens dec. requiring then to ap* pear before the honarable Court at such terms* as your honor may direct, to show cause in any they* have why said copy will of said Charles Kitchens* be established and admitted to probate in sol* emn form and established in lieu of the lost original* And your petitioner in duty bounty will ever pray & c* Barlett and Lofton Petitioner Attorney Additional Comments: Note: This page was found in the Georgia Supreme Court file-'Kitchens vs Kitchens' in the State Archives, obviously as composed by the widow's attorneys. It is unclear whether daughter Sallie Sansome was still living when the suit began-as later versions of the petition interlined the names of two of her daughters, Sarah Cook and Elizabeth Arrington-perhaps indicating their mother's recent death. Though not listed with the girls-brother W. C. Kitchens was shown earlier as having received $125.00 from the estate by administrator Jesse M. Owens. Others shown in the petition are heirs-at-law, Joel Kitchens, Moses Kitchens, Nelson Kitchens, William B. Kitchens, Henry Kitchens, Bartenia Wilson, and Matilda Dearing.
