This petition of William Philip and Garland Dawkins admrs of Joseph Hicks decd shewith? that they have completed the administration on said estate, and pray to be dismissed from the same. It is therefore ordered that citation issue requiring all persons interested in the estate of Joseph Hicks, decd to come forward on or before the 1st monday in March next, and tell their objections if any, they have against letters of dismission being granted to the said William Philip and Garland Dawkins admrs as aforesaid, and that this rule be published once a month for six months in some public gazette of this state. Thomas B. White and William H. White, heirs of Joseph White decd being of lawful age to choose their own guardian came into court and made choice of Simeon Durham for their guardian. It is therefore ordered that the said Simeon Durham be and he is hereby appointed guardian of the persons and property of Thomas B. White and William H. White, and Jacob McClendon, Stephen Mobley and Jack Barley came into court and jointly bound themselves in the sum of twenty four thousand dollars for his due performance of said trust. Ordered that Allen McClendon, Jacob McClendon and Edna McClendon be appointed administrators and Administratrix on the estate of Jonathon McClendon decd and Isaac McClendon, William Armstrong and Simeon Durham came into court and jointly bound themselves in the sum of eight thousand dollars for their faithful performance of said trust, and said admrs and admx were qualified accordingly. Wherefore a warrant of appraisementt was paid to Wm Hancock, B. H. Hardin, Goerge Hend, James Robinson and Robert Butresloft? to appraise said estate. ================= Min A, Page 66 from photocopies ordered from Jasper County, GA. Whereupon a warrant of appraisement was issued to Richard Turner, Daniel Dassy, H. J. Smith, Samuel Henderson and Julius Murdock to appraise said estate. Ordered that Judy McClendon be appointed admx and Joel McClendon and James Crockett admrs on the estate of Francis McClendon, late of said county decd and Thomas Clay and John Vandegress became their security in the sum of four thousand dollars, and the said administratrix and administrators were duly qualified whereupon a warrant of appraisement was issued to Washington Holland, Dunston Banks, Theophilus Pye, Jacob McClendon and Jonas J. Holland to appraise said estate. It appearing to the court that William Trippe guardian of Sarah Trippe and Reuben J. Trippe is about to remove from the state, and that they have chosen Henry W. Trippe as their guardian. It is therefore ordered that said Henry W. Trippe be appointed guardian as aforesaid and Yancy Thornton became his security in the sum of four hundred dollars for his faithful guardianship and that William Trippe on making a return and delivering the effects of said minors over to said Henry W. Trippe be discharged from his obligation as guardian aforesaid Ordered that Stephen Stephens be appointed guardian for the persons and property of Jane and Sarah Stephens minors and orphans of Thomas Stephens decd and William Stephens became his security in the sum of seven hundred dollars for his faithful guardianship On motion it is orderd that Stephen Stephens and William Stephens admrs of George Stephens decd have leave to sell the negroes belonging to the estate of said decd in order that distribution may be made among the legaties of said George Stephens decd Ordered that Jesse Stephens be appointed guardian for James William and Greene Stephens, minors of James Stephens, late of said county decd and Elam Smith and Stephen Stephens became his security on the sum of twenty-four hundred dollars for his faithful guardianship. =============== Min A, Page 83 from photocopies ordered from Jasper County, GA. Application having been made to the court in term of the law for leave to sell the real estate of Aja Ragan decd + there being no objection filed in office. Ordered that the administrators have leave to sell the real estate of Aja Ragan decd arguable to law Ordered that Jophtha Wilkerson and Simeon Wilkerson admrs on the estate of Harmon Wilkerson decd have leave to sell all the negroes belonging to the estate aforesaid, the court being satisfied that due notice has been given to all concerned On the petition of Edna McClendon stating that she is the widow and administratrix of Jonathan McClendon decd and that she has been appointed guardian of the minors of said Jonathan, and the petition further stating that she wishes this honorable court to grant her an order for the distribution of the estate of said Jonathan decd and it appearing to the court that all the partners in interest have waved the necessity of being notified of the petitioners intended application for said orders and it further appearing to the court that there is no objection made to this application. It is therefore ordered that Robert Owens, Mortimer Jordan, John Reid, William Hancock + Ethelred McClendon be and they are hereby appointed persons to divide and distribute the whole of the personal property of said decd in terms of the law in such cares made + provided On meeting it is ordered that Edna McClendon be and she is hereby nominated + appointed guardian of the minors of Jonathon McClendon decd viz. PAGE 98 Ordered that Elizabeth McMichael be and she is hereby appointed guardian of the person and property of Nancy, John and Elizabeth McMichael, orphans of Green McMichael decd under the age of fourteen years, and Amey Castelow and Bardwell Billings became her security in the sum of eight hundred dollars, for the faithful performance of her duty It appearing to the court that James Bullard Senr guardian for the orphans of William Bullard decd has given the notice required by law for leave to sell the real estate belonging to the orphans of said decd on motion it is therefore ordered that the said James Bullard Senr have leave to sell lot number two hundred and ninety-three in the thirteenth District of Monroe County, for the benefit of said orphans in terms of the law The last will and testament of James Hayes decd being exhibited in open court, and having been duly duly(sic) proved in Vacation by the oaths of Luke and Anna Williams, two of the subscribing Witnesses to the same, which was ordered to be recorded, and letters testamentary were granted to Nancy Hayes + Thomas S. Hayes, the Exss and Exor nominated in said Will who were qualified to execute the same whereupon a warrant of appraisement was was(sic) issued to Luke Williams, Jarat Lynch, George Darden, John Darden and John Falkner to appraise said estate It appearing to the court that in the order granted by the honorable court of ordinary of Jasper County at the last term of said court to certain persons in said order named to divide the Estate of Jonathon McClendon decd the name of John Rees was inserted by mistake for Jeremiah Pearson's name, who was intended, and who actually acted as one of the dividers of said estate by request of all the parties legally interested It is therefore on motion ordered that the name of said Jeremiah Pearson be inserted in the order PAGE 99 Ame? proteme, and that the division of the estate of Jonathon McClendon decd made by Jeremiah Pearson, William Hancock and Ethelred McClendon, the same being herewith presented, be received and admitted of record, all the legal representatives Johnathon McClendon being entirely satisfied with said division and truly consenting to this order It appearing to the court that the last will and testament of Arthur Willis decd was proved in Vacation in due form before two of the honorable Justices of said Court. It is therfore on motion ordered that the said will with the probate be admit- ted to record, and that letters testamentary so issued to David Henderson and Jincey Willy two of the executors named in said Wills the other executor to wit Joshua Dodson who was named in said will refusing to act as executor. And it is further ordered by the court that Gilbert Shaw, Jeremiah Lewellen, Obadiah Belcher, William Tucker and Elijah be and they hereby appointed appraisers to said estate Ordered that Richard Cross be and he is hereby appointed guardian of the persons and poperty of George and Pleasant Palemon Cross, orphans of George Cross decd under the age of fourteen years and William Parks and Harris Cross became his security in the sum of four thousand dollars for his faithful performance of said trust Ordered that Green Pinnell be and he is hereby appoint- ed guardian of the persons and property of Jane Kelly, Michael Kelly, and Hugh B. Jasper County Court of Ordinary Nov term 1827 Whereas Polly Owens of said County has made application for Letters of Administration on the Estate of Jacob Owens late of said County dcd. It is therefore on motion ordered that Letters of Adminis- tration be granted to the said Polly Owens and said Estate on her giving bond sufficient security in the sum of Twelve Thousand Dollars + that William Armstrong and Martin Cochran + John Hill be Considered sufficient security in said Case and that Robert Owens, Mortimer Jordan James O. Holmes, Charles McMichael + George W. Colland be the appraisers on said Estate The last will and testament of William B. Livingston having been known by Abraham Key, Ephram Penington + Elared Wilkinson thru of the subscrib- ing witnesses and admitted to Record ordered that Letters testamentary be granted to Thomas Pennington and Mary Pennington Executor + Executrix of said Estate and that Abraham Key, Gilbert Shaw, David Henderson, Amos Cofman + Henry Glom be appo- inted appraisers. Whereas Samuel R. Andrews of said County has made application for Letters of administration on the Estate of Green Andrews late of said County dcd It is therefore ordered that Letters of administration on said Estate be granted to the said Samuel R. Andrews on his giving bong sufficient security in said case + that Jarrel Dearley, James H. Marrow, Robert R. Minter, Cuthbert Ruse + James Grynn be appointed appraisers on said estate In appearing to the Court that Citation has issued Requiring all Concerned to show cause if any they had why letters of administration should not be granted to William V. The petition of Mary Owens widow Jacob Owens late of said County decd and also guardian for Patsy, Edna , Robert and Margaret Owens minors of said decd humbly shewith that she is desirous of having a distri- bution made of the personal Estate of said decd between herself and the said minors for the purpose She prays your Honors to appoint five proper persons to make such distribution and as in duty bound your petition will ever pray Mary Owens admx Widow + guardian Whereupon it is ordered by the Court that Jas P. Holmes, Charles McMichael, Richd Carter, George U.
