This Indenture made this fourth day of January, in the year of Our Lord, One 
thousand eight hundred and forty eight, between Ellison Gross of the State & 
County aforesaid of the one part, and John R. Gross, of the same place of the 
other part, witnesseth that the said Ellison Gross for & in consideration of 
the sum of One hundred & twenty Dollars, to him in hand at & before the 
sealing & delivery of these presents, the receipt whereof is hereby 
acknowledged, hath granted bargained & sold, & does by these presents grant, 
bargain & sell & conveyed (sic) unto the said John R. Gross his heirs and 
assigns, all that tract or parcel of land containing forty acres more or less 
beginning at an Iron Wood corner on the branch adjoining Post thence with 
Post’s line to a hickory corner, thence on Cargils line, to a chestnut corner, 
thence to a sower wood corner on a branch thence down said branch to the 
beginning-being & lying in Eighteenth Dist, Baldwin now Jasper County 
aforesaid to have and have (sic) & to hold said tract or parcel of land to him 
the said John R. Gross his heirs and assigns together with all & singular the 
rights members & appurtenances thereof to the same in any manner belonging, to 
his & their own proper use benefit and behoof in fee simple, and the said 
Ellison Gross, for himself his heirs, Executors, and administrators, the said 
bargained premises, unto the said John R. Gross, his heirs and assigns, will 
warrant and forever defend, the right and title thereof against themselves, 
and against the claim of all other persons whatsoever in Witness whereof the 
said Ellison Gross, hath hereunto set his hand and affixed his seal the day 
and year above written
