The submitter has given permission to the USGenWeb Archives to store the file permanently for free access. http://www.usgwarchives.net *********************************************************************** Mortgage: William Tucker and {Madison} Whitfield Jasper Co, Ga Record: Deed Book D Page 73-74 Date 31 Dec 1842 This indenture made and entered into the thirty first day of December in the year of our Lord Eighteen hundred and forty two between William Tucker of the one part and {Madison} Whitfield of the other part, both of the County and state aforesaid. Witnesseth, that the said William Tucker hath this day made and delivered to the said {Madison} Whitfield his certain promissory note subscribed with his own hand and being of even date with these presents. Whereby the said William Tucker hath promised to pay the said {Madison} Whitfield or bearer six hundred and fifty two Dollars and forty five cents on or before the twenty fifth day of December next ensuring this date whereof for value received. Now for and in consideration of the sum of five dollars by the said {Madison} Whitfield to the said William Tucker in hand paid at and before the sealing and delivery of these presents the receipt whereof is hereby acknowledged as well as for the better securing the payment of the aforesaid promissory note the said William Tucker hath granted bargained and sold and by these presents doth grant bargain and sell unto the said {Madison} Whitfield (300) three hundred acres of land situated lying and being in the County and State aforesaid it being the Lands whereon the said William Tucker now lives in the 15th fifteenth district of originally Baldwin now Jasper County adjoining the lands of William {Shaw}, William Jones, and {John} Lumsden to have and to hold all and singular the rights members and appurtenances thereunto belonging or in any wise appertaining to his own proper use and benefit forever in fee simple. And the said William Tucker for himself his heirs Executors and administrators the said bargained land and premises unto the said {Madison} Whitfield doth hereby warrant and by virtue of these presents will forever defend against the claims of himself and his heirs and against the claims of all other persons whatsoever. Provided nevertheless, that if the said William Tucker his heirs executor, and administrators, shall and do well timely pay or cause to be paid unto the said {Madison} Whitfield his heirs and assigns the aforementioned sum of six hundred and fifty two dollars and forty five cents on the day and time mentioned and appointed for the payment thereof in said promissory note mentioned with lawful interest for the same according to the terms of said note then and from thenceforth as well this present Indenture as the rights to the properly hereby conveyed as well as the said promissory note shall cease deliveries and be void to all intents and purposes.
