We have endeavored to comply strictly to the law of the pension office, as sent in by yourself through that Honorable Lumpkin one of the Senators in Congress from Georgia. We have no hesitancy in saying that the applicant for this pension is fully entitled to it under the pension laws now in force. In testimony whereof I hereto set my hand and annia [sic] the seal of the said court at my office, this 1" day of June 1839 Wm Hotts, Clk ===================================================== State of Georgia } SS Jasper County } On this First day of July, Eighteen hundred and thirty nine, personally appeared before the honourable the Inferior Court for Jasper County sitting in a court of Ordinary, Ellender Flemister said court being a court of ____ -- the said deponent being a resident of said county of Jasper and aged sixty six years Who being first duly sworn according to law doth on her oath make the following declaration, in order to obtain the benefits of the provision made by the Act of Congress passed July the seventh Eighteen hundred and thirty eight, entitled "An act granting half pay and pensions to certain widows" -- That she is the widow of Lewis Flemister and that he was a private in the guard of General Washington who was commander in chief of the American Army during the Revolutionary War and that her deceased husband Lewis Flemister enlisted for the War was with service of the United States seven years, issued on the fourth day of June Seventeen hundred and eighty three -- was honorably discharged from the service of General Washington and for proof of the foregoing facts she refers to the discharge of her deceased husband signed by the commander in chief himself and which is herewith forwarded; and the deponent further states that on the twenty seventh day of February in the year Seventeen hundred and ninety in the County of Halifax and State of Virginia she was legally married to her deceased husband, in the name of Ely Chissum as was familiarly and commonly called by her relations and intimate acquaintances (Ely being a contraction of Ellender)and that the marriage ceremony was solemnized by Hawkins Landrum a minister of the gospel This deponent further states that some short time afterwards she and her husband removed to the state of Georgia - and on the first day of October in the year Eighteen hundred and seven or eight her husband departed this life. The deponent further states under oath that the decease of her husband was made in their family bible - and that book for the ___ of the record, it having been destroyed by her children, she could state particularly the year and that she has never been married since. And also that there was never any record of her marriage other than the one accompanying this declaration under oath. The deponent further states that she was not married to Lewis Flemister prior to his serving in the service of the United States but that the marriage took place prior to the first of January Seventeen hundred and ninety four to wit the true stated in the certificate of the Clerk of the county Court of Halifax County and state of Virginia. Addison Clerk Book A Vol 2d Page 197 ===================================================== Monticello (Georgia) 10th March 1849 Dear Sirs, Sometime about the last of November or 1st December we took the liberty of addressing you a letter, requesting information whether Mrs Ellender Flemister of this County (Jasper), & widow of Lewis Flemister - a soldier of the Revolutionary war, was entitled to a pension -- To that letter we have recd no answer, ____ being it however to the just[?] ___ of business in your office, & to the probable fact that it is a part of your duty to answer such enquiries [sic] -- By reference to papers in your office you will find that Mrs Ellender Flemister drew a five year pension under the act of Congress passed the 7th July 1838 , & on the expiration of that law, as directed by the regulations of the pension office, her certificate was returned to be placed of [sic] file in the same -- Since the above law ceased to be of force, other laws, to wit, the 3d March 1843 - 17th June 1844, & 2d February 1848, have been passed for the benefit of widows of revolutionary soldiers -- We believe that these laws, or at least some of them, embrace the case of Mrs Flemister, & we now do ourselves the honor of enclosing to you the application of Mrs Flemister for a pension under each act above referenced to, & as we think duly an then [sic] treated -- We had an idea at our time of applying for her pensions under the different law, in our Declarations, but on reflection concluded it to be most proper to make out for her a separate declaration to meet each law -- We would thank you to give the enclosed papers as early an examination as the business of your office will permit, & inform us of the result, with the necessary information if we have erred in any particular in regard to the forms we have processed in preparing her papers. That she is the widow of Lewis Flemister who was a private in the life Guard of General Washington, and in the company commanded by Captain Colfax during the Revolution, and that she drew a pension of Eighty Dollars per annum under the act of July 7th 1838. She further declares that she is still a widow. Digby a Jasper County } Justice of the Peace in and for Said County Jeremiah M Gilstrap a resident of the County and State aforesaid well known to me who being duly sworn deposeth and Saith that he was employed by Mrs Ellender Flemister a pensioner of the United States in her lifetime to prepare her pension Voucher in order to draw her pension from the fourth day of March 1854 to the fourth day of September 1854. That the voucher was written and prepared by him this deponent that he copied the said voucher the original pension Certificate and wrote the name of the Secretary of the Interior "Kinny" that this deponent has been informed that he has not copied the name correctly that the name of the Secretary of the Interior should have been copied as "T Ewing" and that said Voucher has been returned suspended by reason thereof That he this deponent copied the name of the Secretary of the Interior as well as he could sypher [sic] it. The same not being written very legibly that in all other respects the certificate as copied by him is a fair copy thereof and this deponent further saith that the whole proceeding was fair and open that Mrs Flemister was then alive and that the pension Certificate is now in his possession Sworn to and subscribed before me } this 30th April 1856 } J. Commissioner of Pensions Sir. I enclose you the letter of an old constituent of mine, who lived many years with me in Jasper County, Georgia where his father died. I have seen the old man's discharge and as I now remember it was signed by Gen. Washington himself. The wife of the old soldier is dead. I am pleased to see the spirit of family pride that actuates the son to preserve this rich heir-loom for his own children. I am well acquainted with the family and know the truth of my correspondents statements. I shall be very glad to be the medium of restoration of this family relic. Hoping my request may meet your approbation.
