Charles Kitchens died in Jasper Co. on Jan. 13, 1864. His widow, Elizabeth said that his will had been stolen, but on advise of counsel, was not encouraged to pursue legal action, the reasons being cited; the ongoing Civil War, and her advanced age. For some reason she did not obtain letters of administration, and the court appointed Jeese M. Owens as administrator. An inventory was quickly made, and on March 9, 1864 a sale brought in $5882.30. Sometime thereafter, Elizabeth produced a copy of the will, which apparently left everything to her! It was presented in Jasper County Superior Court in September 1865. The case lingered in the local court for nearly five years. (See three other pages from the "Court Reports", and a copy of the will).
