"Kitchens vs Kitchens"-Georgia Supreme Court file, Georgia State Archives

William B.(Birdsong?-"Bird")Kitchens was the son of Charles & Elizabeth 
Kitchens of Jasper Co. GA.(One of eight siblings listed in court records). His 
testimony was likely taken in the form of a deposition, regarding the contested 
will of his father, Charles Kitchens. Charles died January 13, 1864 in Jasper 
Co., and William was accused of having stolen the original will the night after 
his father was buried. (This copy was found in the Supreme Court file at the 
Georgia Archives. The original "loose papers" from the Jasper Co Superior Court 
files still exist(Archives), but are greatly damaged by water).

The estate of Charles Kitchens was initially filed as "intestate", an inventory 
was made, an administrator appointed, and distributions were made. Later, widow 
Elizabeth produced a copy of the will. It was presented in September 1865, and 
finally proven by jury-October Term-1867-as the true will of Charles Kitchens. 
After local appeals failed, the case was sent to the Georgia Supreme Court, 
where the local decision was affirmed, June Term-1869.
