I have been unable to edit it on MS Word since shortly after the date noted. Charles Kitchens purchased lot #92/9th district of Jasper Co. on February 28, 1822. Sometime thereafter he purchased an adjacent 202-1/2 acres. He built a small(one room)house on the land, where he and wife Elizabeth raised eight children(and later-grandchildren; the children of deceased daughter, Sarah Sansom). Many believe that Charles was the son of Revolutionary Soldier, Zachariah Kitchens, who died in Henry Co. c.1833, however, there was another Charles Kitchens in Jasper and Henry Co. during the same time-span. Charles Kitchens died January 13, 1864, and according to estate-related testimony, is buried within 50 yards of his homesite. The Georgia DOT map of Newton Co. indicates this long neglected Kitchens family cemetery. (The land was part of original Henry Co., then Jasper Co. at the time of his death, and was later taken into Newton Co.) Because Elizabeth was much younger, it is thought that Charles perhaps had older children from previous marriages. The eight children here are clearly listed as the children of Charles and Elizabeth, in documents concerning the estate(Jasper Co. records & Georgia Supreme Court records). The estate was initially processed as "intestate". An administrator was appointed, an inventory was taken, and distributions were made. Sometime thereafter, widow Elizabeth produced a copy of the lost(or stolen)original will, and the long legal battle began. The "will" was presented in Jasper Co. Superior Court in September 1865. It was proven by jury as the will of Charles Kitchens in the October Term, 1867. After several local appeals failed, the case was taken to the Georgia Supreme Court, where, in June Term-1869, the Jasper Co. decision was affirmed!
