Will of John Cunard 08 Mar 1869 Jasper County, GA State of Georgia, Jasper County In the name of God Amen I John Cunard of the State and County aforesaid, make this my last will and testament ~ To wit ~ Item 1st I desire to be decently buried Item 2nd I desire and direct all my just debts to be paid by my Executors hereinafter named Item 3rd I desire and direct that all my property including land, stock, household, and kitchen furniture and all that I possess to remain together as long as my wife Nancy Shall live for the benefit of her and my minor heirs; provided she lives in widowhood in case she (my wife) marries, she forfeits all claims to my estate. At the death of my wife Nancy I direct all the above named property belonging to my estate to be sold and proceeds of said sale to be equally divided among the following persons ~ to wit: My sons Elbert Newton Henry and Clark and my daughters Anson Jane and Marthina and Mary's children collectively and Matilda's son John individually. Item 4th Henry and Clark each to be sent to school one year expenses to be paid out of my estate Item 5th I desire and direct that my daughter Livson (?) still have a home at my house till my estate is wound up, providing she don't marry in which case she forfeits her claims to a home there Item 6th I desire that if any of the above legatees should die before this will is fully executed without any heirs then portion their portion of said estate be equally divided among the surviving legatees I hereby constitute and appoint my son Elbert Cunard and Jessie McOwens my executors to this my last will and Testament hereby revoking and annulling all other wills heretofore made by me This March 8 1869 John Cunard R.C.
