Wills 1809 - 1907 Written: December 26, 1820 Records: March 5, 1821 State of Georgia County of Jasper In the name of God amen. I being in a low state of health but in perfect mind and perfect mind and memory and knowing the certainty of my death and the uncertainty of life, do think it proper to make some arrangements respecting my worldly goods. 1st. It is my wish and desire that all my just debts be paid. 2nd. I do give and bequeath unto my beloved wife Elizabeth the one half of the lot of lands whereon I now live, beginning on the middle of the line adjoining Moses Powell and running through the center of the lot until you get within sixty feet of being opposite the dwelling house, and then take an offset until the line will run through the center of the passage and continue sixty feet from the house and then return to original course and proceed through the center of the lot to the other line and each half of said lot to be equally centered (?) to the use of the spring. And my beloved wife Elizabeth is to have her choice which half she is to have the full right and enjoyment of during her life, or widowhood, and at her death or marriage the said half lot is to revert to my other legatees equally. I do also give unto my wife Elizabeth one sorrel mare, one bed, bed stand and furniture, one trunk and as much kitchen furniture as may be necessary, one cow, one sow and pigs she calls her own and one Negro woman named Sarah during her life or widowhood and at her death or marriage to revert to other legatees. 3rd I do give and bequeath unto my son William Flowers one half of that lot adjoining Sanders Vann and he is to have the half as it is now laid off which joins said Vann’s 4th I do give and bequeath to my son James M. Flowers the other half of said lot which joins said Vann’s 5th I do give and bequeath to my son Theophilus Flowers the one half of the lot whereon I now live, agreeable to the way I have pointed out for it, to be laid off. 6th I do give and bequeath to unto my daughter Catherine Flowers nine hundred dollars to be make up out of the Negros at the appraisement if she think s property to take the property if not that amount in cash. 7th I do give and bequeath to my daughter Eliza, nine hundred dollars in the same way that Catherine’s is made. 8th I do wish one hundred and fifty dollars to be taken out of Catherine’s portion for the education of her daughter Adeline, which money I wish my executors to reserve for that purpose. 9th I do give my son William one sorrel horse with a bald face. My son James one sorrel horse and shank My son Theophilus one sorrel mare generally called his, and one hundred and twenty five dollars to each of my daughters, Catherine, Eliza to be made out of the other property as an equal for the horses, the horses not to be removed before the first of March next. 10th I do give my sons James and Theophilus and my daughters Catherine and Eliza to have one bed and furniture each equal in value to the one which my son William has received. 11th I do wish the present cash now on hand to remain for the use of the family the remaining year and also the hogs which is intended for pork to be killed and salted up for the use. 12th I do wish all the balance of my property which is not already pointed out to be equally divided amongst all my children say William, James, Theophilus, Catherine and Eliza other by sale or division. 13th I do appoint my friend John Heard, brother Sanders Vann, and my son James M. Flowers to carry this my last will and testament unto effects given under my hand and sea this 26th December 1820 NB: If my beloved wife Elizabeth should have another child or children after or before my death so as to be a lawful issue, it is my wish that the child or children should be raised and educated out of the property given to my wife and also receive the same if five hundred in money if the said property will make that amount. Flowers Signed, Sealed and acknowledged in presence of: John Heard Theophilus Freeman Moses Smith Ordinary Office, Jasper County Ordinary Court, March term 1821 Personally came unto open court, Moses Smith, Theophilus Freeman and John Heard subscribing witness to the within will and being duly sworn say that they saw Edward Flowers sign, seal and publish and declare this instrument of writing to be his will and testament, and at the time of his so doing, he was of a sound and a deposing mind and memory. Moses Smith Theophilus Freeman John Heard Ordinary Court March Term 1821 Jasper County, Georgia Personally came unto open court Moses Smith, Theophilus Freeman, and John Heard subscribing witnesses to the within Will and being duly sworn say that they saw, Edward Flowers, sign, seal, subscribed and declare this instrument of writing to be his will and testament and at the time of his so doing he was of a sound and disposing mind and memory.
