Item 1st: I desire & direct that my body be buried in a decent & Christian like manner suitable to my circumstances in life. Item 2nd: I desire & direct that all my just debts be paid without delay. Item 3rd: I will & bequeath unto my daughter Aney Brown, wife of Alfred H. Brown four hundred dollars. also I will & bequeath to my daughter Theresa Smoot wife of George Smoot four hundred dollars. Item 4th: I will & bequeath unto my son Theophilus Pye one share of all the property of which I may die possessed not otherwise disposed of. Item 5th: I will & bequeath unto Lucy Castilow, wife of William Castilow, Zemily Young, wife of John Young, Jefferson Pye, Sarah Jenkins, wife of Francis M. Jenkins, Freeman Pye, children of my son Lewis Pye deceased, & my grand daughter, Sarah Jenkins daughter of the said Francis M. Jenkins by his first wife Elmira Jenkins also the daughter of said Lewis Pye one share of all the property of which I may die possessed not otherwise disposed of. The portion falling to Zemily Young to be for her separate use for & during her natural life free & exempt from the debts & liabilities of her present or future husband. Item 6th: I will & bequeath unto my son Asa Pye one share of all the property of which I may die possessed not otherwise disposed of. Item 7th: I will & bequeath unto my daughter, Aney Brown, wife of Alfred H. Brown one share of all the property of which I may die possessed not otherwise disposed of. Item 8th: I will & bequeath unto my son, Jordan Pye, five dollars & one half of all my stock of all kind. Item 9th: I will & bequeath unto my daughter Patsy Clay, wife of Jesse F. Clay for her sole and seperate use for & during her natural life free and exempt from the debts of her present or future husband & at her death to equally divided among her children one share of all the property of which I may die possessed & not otherwise disposed of. Item 10th: I will & bequeath unto my daughter Theresa Smoot wife of George Smoot one share of all the property of which I may die possessed not otherwise disposed of. Item 11th: I will & bequeath unto Elizabeth Pye, Amanda Pye, Sarah Pye, Nancy Pye, James L. Pye, children of my son Griffin L. Lovejoy ordy Whereas it has been represented to me by Harmon W. Pye, that James Pye late of said county deceased died testate, having at the time of his death a considerable personal property, and whereas it is further represented to me that there is great danger of waist (sic) of said estate, for the want of dire and legal administration being had on the same, and by the statutes of this state the ordinary has the power of granting temporary letters of administration. It is ordered upon the above representation that Harmon W. Pye be and he is hereby appointed temporary administrator until the first Monday in May next, upon his giving bond in the sum of thirteen thousand dollars with Theopilus Pye as security and that William H. Pritchett, P. A. Compton, T. B. Mcmichael, S. I. Mcmichael and L. Hines, be appointed appraisers. Jasper court of ordinary March 9, 1856 Harmon W. Pye temporary adm. on the estate of James Pye decd, having returned the appraisement on the estate of said decd desires an order to sell the perishable property of said estate. It is ordered by the court that leave be granted the said Harmon W. Pye Adm. as aforesaid to sell the perishable property by giving at least ten days notice. P. P. Lovejoy, Ordy Page 238 It appearing to the court that Harmon W. Pye has published in a public gasett (sic) of this state notice of his intention to apply at this term of the court for letters of administration upon the estate of James Pye late of Jasper county deceased. Thirty days previous to this term of the court, and no objection to the same being made, it is ordered & adjudged by the court that the said Harmon W. Pye be and he is hereby appointed Administrator of the said James Pye dec'd and it is further ordered that he do give bond with Theophalus Pye as his security in the sum of twelve thousand dollars for the faithful discharge of said trust and it is further ordered that as the said Harmon W. Pye has already under temporary letters upon said estate filed an appraisement of the same it is ordered that he be discharged from filing an appraisement, under these letters of administration. State of Georgia, Jasper county: Know all men by these present that we Harmon W. Pye principal and Theopulus Pye security are held and fairly bound unto the ordinary of said county and his successors in office in the sum of thirteen thousand dollars to the payment of which well and truly to be made we bind ourselves our heirs executors and administrators, of us and each of us firmly by these presents subscribed with our hands and sealed with our seales (sic) this 7th day of March eighteen hundred and fifty six. The condition of the above obligation is such that whereas the above bound Harmon W. Pye has this day applied to P. P. Lovejoy judge of the court of ordinary of said county for and has obtained temporary letters of administration for the goods and chattles rights and credits of James Pye deceased, now if the above bound Harman W. Pye shall carefully collect and preserve from waist (sic) or loss all the goods chattles and effects of the said James Pye deceased and shall make or cause to be made, a true and perfect inventory of all such estate and the same being so preserved, do surrender up such estate, and effects with the inventory aforesaid unto the legal and proper administrator on as before the first Monday in May next or so soon theeafter as the court of ordinary shall direct with all his other actings and doings therein and faithfully perform the trust reposed in him.
